Can apply FSW without LMIA

I'm eligible under both CEC and FSW and recently got invited to apply under FSW category, but I have an open work permit instead of LMIA, am I still eligible to apply under FSW? How can I change to CEC? Thanks everyone for your kind help!

Yes, you can apply under the FSW. The LMIA really only counts for points while trying to get an ITA. If you aren't putting down that you have a LMIA and aren't getting the extra 600 points you are fine without it.
You can try to change to be only eligible for a CEC by altering your profile and saying you don't have an ECA. Of course, then you won't get points for your education and then you might have a low score. Basically you need to look over you profile and see what qualifies you for the FSW and remove whatever qualifies you for that, but won't cause you to not be qualified for CEC.
The CIC doesn't allow you to just choose which one you want to apply unders.

Thank you for your kind reply. yes, I did fill out the ECA information for my bachelor degree while registered for EE. But I got a master in Canada so it counts that as the highest score I guess? I choose "if you have a job offer" as "no" so I didn't fill in any LMIA infor. From your elaboration, I think I'm ok to proceed with the FSW then? :)

Not sure about which points you got for the Masters vs. the Bachelor since I didn't have that. Since you said no on the job and you aren't getting points for having a LMIA you are fine. Good luck!

As the other member said , LMIA only count towards ITA.

I was also eligible for both FSW and CEC , I also have a Canadian master's.
I got a ITA in march for FSW withdrew it , re submitted , again got ITA in June again as FSW.

As far as I can see we cant do much to change the program under which the invites are sent !
It does not make a big difference in terms of processing , just submit the requested document !

There really isn't a difference, as caps for different NOCs under FSW have been removed. And it does seem that CIC offers FSW to everyone who qualifies for both. I am in the same position and was hoping for CEC, but wouldn't have rejected my invitation unless I absolutely had to, so I applied under FSW since that's what was offered. Still waiting, but if people enter the truth in the EE application and find out they're qualified for both programs and invited under one, I have no idea why they would reject their invitation!

I rejected my First ITA cos I had to correct minor error in my profile, I was hoping I would get picked up in the very next round , but took a while (3 months) .
I also was not sure if I could have two application being processed at the same time ( I had already submitted my paper PNP application).

As you say , I strongly recommend not rejecting the ITA !
If I had submitted it with First ITA , I might have gotten my PR by now !
