If the VO decides to refuse the application, it should be shortly after the missed interview. They can't change the type of application - if they refuse, you would have to submit a new application.
Or you can appeal the decision.

What would be the chances of winning the appeal when the applicant didn't go to the interview?
If they reapply inland, his wife can stay with him in Canada while they wait, but the processing times would be over a year. If they reapply outland, she would have to go to India, but the processing times for India are very quick, often just a few months. If they appeal, could she stay in Canada waiting for the year or more it takes to get a hearing?

well i happen to hire the lawyer for her case as i find it to be very complicated , and i happened to ask him abt the possible chances . He said that hes gonna submit a strong explanation of why she cud not appear fr the PR and that request a positive decision or ele he recommends file transfer !

Cuz he thinks or case has serious issues and hence he does nt suggest inland cuz if rejected then , we have no rights to appeal. So basically i have to wait until wht they decide . But i was wondering what Rjeesome just said that we can appeal (only shes refused )and if she cud stay here with me while the appeal is in process ...woow that wud be great !!

Without knowing all the details of the case I couldn't say what the chances of success would be in an appeal but remember, the OP was included as a same sex partner in HIS application for PR and now he and his ex-partner have both sponsored wives. CIC smells fraud. Inland would probably be refused as well and then there is no right of appeal other than a judicial review where CIC must have erred in law. No, I would not recommend inland if they are refused.

The lawyer is right to try this. I would as well. But be prepared as it may not work and appeal may be your only option. It will be up to CIC whether or not they would revoke her visitor record. I doubt they would but you never know. You need to be aware that if CIC smells fraud in YOUR PR and digs their heals in, they could cause trouble for your PR as well.
