Hi All,
If a person is HIV Positive and is under ART treatment, but the CD4 is above 500 and Viral Load is undetectable and if he applies with his wife (Spouse) who is NOT HIV infected can such a case get PR?

It depends how your HIV status is assessed in the medical. Some are approved - however I believe many are not. I would recommend you search this forum for historical posts on the subject of HIV. You will find example there of what people have experienced in the past.
 
I searched, but not found what I want, like there are couple of ways to have the PR but I don't know if it is going to work or not.
1. I will tell the Dr that I am not on ART and I physically fit without medicines, then if PR is approved, can I start the medicines over there?
2. What if my Wife apply as a main applicant as she is HIV Negative and then I can be attached as a spouse?
3. Can I tell the Immigration officers that if they are concern for medicine than can I parcel the medicines from my country to Canada (by this they won't be having any burden of cost)

I'll help with two questions:

2) It doesn't matter who is the primary applicant. Both of you will still have to pass the medical.
3) No - this won't work. If CIC sends you a letter letting you know they plan to refuse your application due to excessive demand, you'll need to prove that the cost of your care will be less than $6,500 per year with the medication purchased in Canada.
 
So what do you think for option 1 and So I can't have medicines from another country at my own cost? for instance the cost of medicines will be 100 CAD per month if I bring from India so total will be 1200 CAD and then as a rule every 6 months I need to have Cd4 test and such, that can be done in canada itself which I don't think will take more than 1000 CAD so calculating it will be 1200 + 1000 = 2200 CAD, let us assume 3000 CAD (800 CAD as buffer) still it is less than half of 6500 CAD, will not it work?
 
Once you are a PR - you have access to the Canadian health care system - just like anyone else. If these medications are typically covered through the health care system - then arguing that you will buy them yourself won't lead to an approval. Again, what you need to prove is that if you fully leverage the Canadian health care system, the costs of your care will be under $6,500 per year.

You should also be aware that you are legally allowed to bring a maximum of a 90-day supply of medication with you when you travel to Canada. Anything above a 90 day supply is not allowed and may be confiscated (plus you may face fines). You cannot have others bring medication for you and also cannot mail medication.
 
Scylla thanks for your constant replies, can you please elaborate "need to prove is that if you fully leverage the Canadian health care system, the costs of your care will be under $6,500 per year." Actually I didn't understood what does it mean. It will be good if you can give any example.
 
Again, I would encourage you to use the search feature of this forum to find old threads on HIV and excessive demand.
 
Someone having HIV does not automatically disqualify someone from getting PR in Canada, it will rely on other results of medical tests and other factors that people already mentioned as well.
