My partner is a foreign temporary worker. She has a closed work permit, but lately, a new boss has emerged and is giving her a terrible time.

Is it possible for her to seek another employer willing to give her a closed work permit, so she can leave her current job?
By that I mean, continue working for the crap employer, and in her spare time, ask around different employers if they're willing to offer her a closed work permit.
Essentially, replace her current closed work permit with a new one, from a new employer.

Thanks in advance.

New employer will need to apply for a LMIA, get it, and then your partner can apply for a new closed work permit. She can't change employers on a closed work permit.

That's perfect, thank you. Yeah, we know she can't work for someone else with the same closed work permit, we just weren't sure if she could replace her closed work permit with a new one, for a new employer.

I've just begged her to start asking around. There's plenty of opportunities nearby and she has 10+ years experience, and can start immediately as a fully vaxxed employee, already local, no qurantine required. Here's hoping something bites.

Thanks again!

The issue is she can’t start immediately as employer must file for the LMIA, and then file for work permit. And both applications will take months to process. Just the work permit will take at least 3 months to process. Hope it works out.

Makes sense. Can she keep working at her current job until the entire process is complete on her new (theoretical) closed work permit, then jump ship?

Yes, you can certainly do that.

Think WPs are taking closer to 5 months these days. Depending on what industry she works in it may be difficult to get an LMIA since Canada wants those who have are legally able to work first to go back to work first and off EI and CERB replacement. Looks like you’re applying for PR so if you’re common law maybe you’ll get PR before the WP.
