Good day everyone, I hope you are doing well. I have this question about claiming point for LMIA-exempt job offer. From my understanding, you will need both closed work permit and job offer to claim 50 points. However, my HR said that I can update the profile and claim 50 points as soon as they issue the offer no need to wait for the work permit approved. The company has applied for the close work permit and I am on PGWP. Thank you everyone and have a great day.

Do you mean for the purposes of your EE profile? If so, you can't answer yes to the question on whether you hold an employer specific work permit until that work permit is actually approved. That's the only way you can claim the 50 points.

I mean HR generally aren't immigration experts. So I wouldn't rely on them for any immigration advice.

If you say yes on the employer specific work permit in your EE profile and then get ITA (when you don't actually hold an approval closed work permit), that's misrepresentation. You'd be lying in your EE profile. IMO this is very clear cut. You do not hold an employer specific work permit at this time.

I feel the same too but my HR said other employers did claim. I will check with my consultant to be more sure.

It's very simple logic.

IMO misrepresentation of any kind is dangerous territory but your call again.

I feel that too. I will update again then loll. However, they will remove the point soon so I get i am fucked when i got my work permit.

I get that. But you can't claim points for something you don't have. This is how you end up with a refusal (best case) or refusal + 5 misrepresentation ban from Canada (worst case).

If you get ITA, you can't submit your application and claim job offer points unless on the day you received ITA, you actually had an approved closed work permit.
