I currently work in Ontario with post-grad work permit and my wife works back in our home country – Bangladesh. Being the principal applicant of OPPNP, I applied for PR this January. I submitted all our applications, documents and fees for both ourselves.

Now my questions are:

  • What happens to my wife when I get the AOR/ Med Request?
  • Will I get these to my address here even on her behalf?
  • It’s pretty obvious that she will do her Medical in Bangladesh. So, will the medical centre send her medical to Canada (wherever it needs to be sent)?
  • What happens afterwards (i.e. PPR, landing etc.)? Will her files will be handled separately from here on?

I will appreciate if someone can enlighten me on this. This will be helpful for upcoming events. :)

HI Rossei:
I am been following ur posts for quite a few time now . I hv noticed that you have still not asked ur wife to apply for visitor visas? Visitor visas for spouses are rarely denied once the PNP is approved.
I and many of my friends here in saskatchewan are successful in getting their spouse visas. Why dont you give a try?

I have a question, My wife is coming next week and am still a little confused that can she apply for open work permit at port of entry?
Based on my skilled job, she is elegible for OWP......But I dont know if she can get it at the port of entry?
It would be great if she can get it from the airport cz the waiting time from vegerville is very long.

Surely, you did not follow everything ;D.

She actually applied for Visit Visa a few months back from Bangladesh and was refused. It broke her heart. One of my colleagues who work in my company and has exactly similar situation had her wife come here as a visitor. Only difference: his wife is a university student and mine is a working doctor.

Anyways, congrats that your wife is coming over here. You said you have a skilled worker work permit; then your wife can apply for OWP at the port-of-entry. If yours is an OWP as well, then your wife is NOT eligible for an OWP.

She will require these at POE to get an OWP:
  • Copy of your work permit
  • Fees of $150
  • Proof of your marriage
I've seen forum topics on this subject; but can't find now. You can browse through. Besides, you can talk to PMM; he is much knowledgeable on this.

HI Rossei:
I am a little confused with your answer. So for her to get a OWP, do I need to have a closed work permit with a skilled job?
I have a open Grad work permit but I have a skilled job, what difference does it make? As far as the law states ---spouses of highly skilled workers are eligible for open work permit.
I would be giving my wife my job letter which clearly states I am an engineer; I would also tell her to carry my PNP certificate which states my NOC code 2132- mechanical engineer. I am eligible for 3 years employer based closed work permit when I got my PNP, but really dont think it is necessary in my case. I have a grad permit open till end of 2012 and I will be getting my PR well b4 that. I have kept my 3 year extension work permit as a last line of defense if something goes wrong.
Let me know if she is still eligible based on my current situation. I need to know quick cz I just have 5 days left.

Regards,
SAM

I'm on Post-Grad Work Permit as well which is actually OPEN like you said. Yes, you are eligible for a closed work permit based on your PNP certificate (and they gave you a paper to forward to CIC if you already haven't got any type of permit - think about the Masters & PhD stream). I was confused too; hence called CIC call centre. They confirmed me that my wife is NOT eligible for any kind of work permit since I got an OPEN work permit. I don't know whether the situation changes if you got a skilled job upon OWP. I, myself, is an Electrical Engineer (NOC# 2133), working for Govt. owned company. But neither 2132 nor 2133 is among the FSW categories.
Check: http://www.cic.gc.ca/english/immigrate/skilled/apply-who-instructions.asp#list

I will recommend you to call CIC for further clarification.

Well worse case scenario. If she is denied work permit at port of entry, I guess she can apply from within canada to vegerville. Does is create any proble at the port of enrty asking for a work permit? Cz i had initially states that she is just coming for a 1 month visit...
suggestion?

I read this long back. I can give you more hopes on top of that: http://www.cic.gc.ca/english/work/apply-who-permit.asp (read the SPOUSE part).

But it wasn't me who made that decision. It was rather CIC Call Centre who said that MY WIFE WON'T BE ELIGIBLE FOR AN OWP. I actually called them re: the required docs need to be shown at the POE for OWP for her. And they came up with this. Since she never got the Visa; I did not dig through much later.

Answering your other question, I don't know exactly how long her visa is valid for. If it were only for a month, she can apply later to extend it and then apply for work permit or something. Nevertheless, there is no harm asking for an OWP at POE I guess.

Hey guys,

Just wondering when I carefully reading the whole thing I noticed SAM told that your spouse can apply for visitor visa when you approved for PNP category. Which make me confused. Can you just clarify it? how he/she needs to apply. Do he/she need to show the PNP certificate to the visa along with other papers.

Thanks,

Rossei

Your spouse can apply for a TRV/ Visitor Visa based on your Work Permit. But I don't know how exactly a PNP Certificate helps to strengthen your application for TRV. Sam knows better as his spouse got the Visa (and I did not :().

PS: I opened this topic re: Spouse's PR application procedure with Buffalo, NOT her chances of getting a TRV. There are forum topics re: that. So, I cordially request every1 to respect the topic. Thanks. :)

Now I'm going off-topic since noone is interested in my original question. SAM probably removed one of the latest replies to SROY which contained a PDF file link. The guide was about the regulations of bringing your wife here based on your skilled job or something (can't remember exactly). SAM mentioned about couple of sections to read.

If any of you still has it, please post it again. Thanks.

HI Rossei:
I didnt meant to take it out, but as we were going off the topic ..i just dont want to corrup the board. I emailed you yesterday about foregin workers manual. study it properly, there is so many sections that neither the immigration consultants nor the officers stamping visas at the airport are aware of our rights.

http://www.cic.gc.ca/english/resources/manuals/fw/fw01-eng.pdf
section... 5.27, 5.30, 5.39

let me know if it helps.
I can delete the post if you thing its going off topic from these board.

Regards,
SAM

Hey Sam, thanks for it. It's a long document to read and find stuff. But I know now what you were talking about before re: OWP for your wife. I hope you sorted it out by now.

You said earlier that PNP certificate eases up an appliaction for TRV for your spouse. Do you have any similar docs/guides on that? I'm interested to know more. It's that my wife doesn't get the VISA let alone an OWP. :(

Thanks.
