Buffalo or New delhi ?

I am an Indian, in US on a visitor visa. I am near the end of my stay but I am applying to extend my stay here for another 6 months, which is most likely to be approved because my reason is legitimate.

I want to send my app now to canada for skilled worker.

1.Can I opt for buffalo? This is because I do not want to go back even if New Delhi is faster.
2.How long are they taking in buffalo?
3. Do they waive interviews for 3rd country nationals at buffalo?

Hi,

Depending on your current visa status in US, I suggest New Delhi. New Delhi seems faster than ever before.

1. If there's an interview -yes.
2. Also u may have to make personal arrangements to get your pps back [maybe for sending too], as India doesn't permit sending pps overseas.

BTW: if possible, like others opined, CHC-ND is 'faster' nowadays... choose ND over Buffalo.

What is PPs? Is it passport? I thought they will need the passport only when stamping the visa. Why do I have to send it to them before?

Hi,

I had replied only to the quoted portion... not seing your original post. Here's the story:
1. U cannot apply at Buffalo as u do not meet the criteria of 'legal resident' of that country, for 1 yr, during your applying stage.
2. Yes by pps I meant passports. However, that was taking the view that y r a resident of the US & wanted to apply at CHC-ND.

Ok. Let us assume I changed my status to one year H-1 in US and then opted for New Delhi.
Why and at what stage would I need to send my passport to New Delhi in that case?

U'll send the pps when the CHC asks u to. That's called a PPR... which can come either separately or clubbed with the meds [in fast track system].

I was in almost a simlar situation like yrs a year back and made a wrong decision to apply to Buffalo for reasons stated below:

a.Buffalo is slower in processing than ND

b.Considering that you are on H1-B,in case your project ends and in unfortunate circumstances,you have to relocate back to India while your application is still under progress@Buffalo,you will not be able to attend the interview etc at Buffalo(not to mention that sending of pps to Buffalo itself will be a challenge)unless you apply for US visitor visa etc(you will be able to come back on H1 unless you have a project/job out in US)

However if you apply to ND and even if you are called for an interview while you are in US,you will not face any of the issues enlisted above..

I am an Indian national, currently on a H1 and live in the US.
I had applied to the CIO Sydney (for FSW stream) in Nov 2009. They mailed me in the end of Jan 2010 and asked me to send the application to Buffalo by end of May 2010. I am currently waiting for the FBI clearance letter.

Meanwhile my H1 expired (after 6 years) recently and our application for H1B renewal was denied a couple of days back. So as of now, I am "out-of-status" in the US, and I have to leave the US ASAP. I am leaving for India soon and I am not sure how soon I can come back to the US.

On the other hand, the FSW processing times have changed: (www cic.gc.ca/english/information/times/international/02b-skilled-fed.asp). Basically, there appears to be not much difference in processing times between Buffalo and New Delhi.

Here's my question #1: Should I continue to file my application with Buffalo, or as I am going back to India now, should I file it with New Delhi. If I go with New Delhi,
a) do I have to inform Buffalo or CIO or New Delhi offices about the change?
b) all my experience verification letters are addressed to Buffalo office. Will I need to change them?


question #2: It looks like FBI clearance may not come in before the CIO deadline. Can we submit it later (as a separate document), quoting my file number, once it is available. (I can post this in a relevant thread if required).

All suggestions and inputs are welcome, greatly appreciated and obliged. If I need to provide more information about my situation, please let me know.

Rest assured currently CHC-ND is a tad faster than CHC-Buffalo. Said that here's the answers to your query:

1. If u r not sure about our return to US, u better send the 2nd stage apps to ND. 'Coz, if there's an interview u'll be in trouble. Yes, u'll have to inform CIC. It's called Request for 'change of Visa Office'. Write to CIO-NS [with a cc to CHC-Buffalo & CHC-ND] thru regular postal media... 'coz u cannot approach CIO vide emails.

Justify your need for the change in detail [add a suave plea for accepting the change], as they 'usually' do not encourage this. Their view is that u should have known earlier about your situation. Remember, it is an 'elimination' process till this stage, not a 'selection' process.

Probably, they will not reply. But, when u send your complete docs to CHC-ND, enclose that letter of yours as a justification of your having applied for the change of Visa Office. Here, again write a modest cover letter ['plea' is the key word].

2. Yes, u can submit the 'complete application+docs' to CHC w/out the FBI Clearance. And can forward it later when it comes by. Repeat, repeat, repeat: write a cover letter for the same requesting them to accept the FBI Report later.

HI Immigranthope - I am in the same shoes as yours except for I am not applying for extension of my Visa.
At this point I already got an email stating that I should apply to Buffalo office and I have submitted my fingerprints to FBI.Now I will be permanently relocating to India in few days from now. Is that possible to change to New Delhi Office by requesting them, This will avoid lots of hassle.When I started applying before few months I was not sure about my relocation and also was unsure about Buffalo's slow response. Seniors please advise.

Hi all,

While I was researching about my specific case, I came across this bulletin. www (dot) cic.gc.ca/English/resources/manuals/bulletins/2010/ob180.asp

"Visa offices are not required to transfer files for any other reasons. Such reasons include cases of applicants who comply with subsection R11(1) for the specified visa office, at the time the application is received at the CIO, but subsequently leave the territory of the specified visa office. In these cases, the original visa office should proceed with a final determination of eligibility and process the application if eligible. The visa office should not transfer the file to another visa office unless the transfer is warranted for program integrity reasons. Leaving a visa office’s territory alone does not warrant a file transfer. In this case, if an applicant requests a file transfer, the visa office should inform them that the application will not be transferred and that they are required to submit a complete application to the visa office originally specified within the 120 day deadline allotted by the CIO."

I guess I will still try to send a letter to CIO, as if I don't return to USA, it will be difficult to send my passports by mail, or visit USA for an interview etc.
