Hello! I'm so happy to have found this forum an hope that someone here can advise me! I am a Canadian citizen and have lived abroad in the UK for almost 10 years. I have been married to my British husband for 2 years, 3 this September. We have decided to move back to Canada to be closer to my aging parents, and because we feel that the natural beauty and spacious communities are more in keeping with the lifestyle that we both want. We've bought a house (yay), and are due to move into it in 6 weeks. My husband is employed in London, and works from home entirely over the internet. His company has given the ok for him to reside anywhere in the world we want.

When I spoke with the Canadian Embassy in the UK I was advised that it would be best for me to fill out the applications to sponsor my husband to live in Canada once we are already residing in Canada.

So now my questions are many;

Does my husband need a work permit while my family sponsorship application is being processed? Does he need a work permit at all since the income he is receiving will be from London? How do we pay taxes in the mean time?

I am not employed and have not been employed in Canada for almost a decade as I have been living in the UK and am also returning to Canada, will this affect my ability to sponsor my husband?

How do I get my husband onto Medicare in the mean time?

We are moving to New Brunswick; what are the application fees?

When I spoke with the Canadian Embassy in the UK I was advised that it would be best for me to fill out the applications to sponsor my husband to live in Canada once we are already residing in Canada.I would strongly advise to apply as "outland" and not "inland" - inland takes much much longer than outland for applications going through London, and since your husband is from a visa exempt country, he can move there on a tourist visa, and keep on residing with you until he gets his PR. for more information about outland/inland process, read the first post from Leon at the top of this page, and it will give you more details.

Your husband can go as a tourist with you. Best way to do it would be to put together the application, pay the fee, send your application and then travel to Canada. Once at the border, make it clear that your application has been sent, and the border officer will decide how long your husband visa will be for. Usually 6 months, that can be extended for another 6 months while in the country. But he won't be able to work in Canada. Now - because he is receiving an income from the UK I am not sure how it will work, I am not competent enough to answer that question.

As a sponsor for your spouse, there is no minimum income to reach. You need to show 2 things mainly: that you have a plan to support yourself when back in Canada - include which job you will get , where you will stay etc - what's your plan in general, and you also need to prove that you are returning to Canada. But the fact that you bought a house, is already good - explain when you plan to go, what you have thought about, maybe some emails exchanges with friends or family explaining your plan etc - anything to prove that you have the firm intention to come back to Canada. the fact that you have not been employed in Canada doesn't have an influence.

How do I get my husband onto Medicare in the mean time? you probably will have to get a private insurance. Some provinces allow coverage for PR applicants in family category (BC does apparently) but not sure about New Brunswick.

We are moving to New Brunswick; what are the application fees? application is the same wherever you move - 1040 total, if you are sponsoring your husband only. your application is sent to Mississauga, and once approved there, they will send it to London.

Regarding tax, you and he will have to file in both countries and you will have to include worldwide income. But you will not be double taxed (of course, you have to show that you are filing in both countries and being taxed in one in order to receive deduction from the other). I do not know exact steps to do this. The term "living" is used differently by CIC and CRA. CIC uses "living" very narrowly, only those who have PR or citizenship status, whereas CRA uses it widely in order to tax more people and more money!
