Hi everyone,


I am in a tricky situation and I would appreciate your advice and insight.


I received a PR refusal from IRCC on March 6th because they found my NOC category unsatisfactory. After discussing this with my immigration consultant, he agreed that he chose the wrong NOC code while applying for my PR.

(A bit of background: I have a master's degree in Food Science and Agricultural Chemistry from McGill University. Previously, I worked as a research assistant for almost a year at McGill and currently, for more than a year, I have been working as a food technologist in a food company.)


My consultant has submitted an appeal to reconsider my application, stating the correct NOC code. I will also reapply for PR in the next few days. However, my work permit expired on February 20th. I applied for a BOWP on January 24th, and it is still in progress. I want to know if I am still in implied status and can continue to work at my company.

Any insights will be helpful. Thanks in advance

Yes, you have implied status and can continue working since you haven't yet received a decision on the BOWP application. If the BOWP is refused, you will need to stop working.

Thank you! I had submitted the confirmation letter from IRCC regarding my BOWP to my HR. In that document it clearly states I can work until July 27th until a decision is made. Today I informed my HR about my current situation with my PR application and now they are asking for supporting document which confirms my implied status. I am not sure what other supporting documents I can provide. Is there a IRCC web page I can share with them?
