Boyfriend Visiting Canada

[size=10pt][size=10pt]My boyfriend lives in detroit I live in Windsor Canada, he stays with me in Windsor at least 3 times a week, he always returns back to his home in detroit. Immigration pulled him in refused him entry and told him to prove he does not live in Canada he did that he showed them his check stubs, lease,bank statements etc. They still continue to harrasse him.

Yesterday they told him that he is visiting Canada to much and if he didn't stop he was going to be banned from crossing the border for a year. How can they do this to a person that has his own home,job , family etc in the united states, he has a passport, never been in trouble with the law, is there anything we can do before things get worse, should he hire a lawyer?

I don't think you can do anything about it, that is a general rule. and the worst thing is that they enter all this info in their database, so crossing the border at another port of entry will not make the situation better - he can really be banned for a year.
have you thought of getting married and starting a sponsorship procedure?

We are not ready to get married as funds do not allow it at this time, in the future yes but right now I can't even pass the sponsorship application as I am not working.

My brother inlaw went through the same thing he has children and grandchildren in canada but was banned for a year because they thought he lived here, it doesn't seem fair at all.

Well thanks for the advice , I think we should still seek the advice of a lawyer, immigration told my brother in-law to appply for a visa how does that work he lives in detroit , I thought a visa was for people in other countries.

The problem is that if he stays at your place "a least 3 times a week" he's really living in Canada and just commuting to Detroit for work. It sounds like he's sleeping in Canada more than he's sleeping in Detroit. This is definitely a problem.

There is no income requirement to sponsor your spouse to Canada. You can sponsor your spouse or your common law partner even with no income at all. (You'd have to live together continuously for a year to be considered common-law partners.)

A visa would probably be a "permanent resident visa" which is usually the first step to becoming a citizen of Canada. That's what you could sponsoring your husband for if you were married.

They can do it, because as a U.S. citizen he has no right to enter Canada, much less almost live there. There is nothing a lawyer can do about this; it is the law.

If you get married you could sponsor him for Canadian PR or he could sponsor you for American PR.

I don't understand you say as a u.s. citizen he has no right to enter Canada, what does that mean? I thought you were allowed to visit Canada when ever you wanted, as long as you were not a criminal, I don't think 3 times a week should be considered living here, he does stay at his own place also and not just commute to work , he has his mom ,sister , and niece that he looks after in the states .

I don't know is there anyway that he can bring his self across without having someone sponsor him, how do people come to Canada and live that have no family at all?

US citizens have a right to enter their own country, the United States. Entering Canada for an American citizen is a privilege not a right. So being granted the privilege to visit doesn't mean one will always be given it. Even if he's not a criminal, he has been warned. Probably your boyfriend has been to Canada too often and his being here too often is construed as living here.

He can apply for a job and obtain work permit or apply as an immigrant under one of the immigration routes - PNP, FSW.

You are allowed to apply to visit by going to the border and ask to be let in, but there is no guarantee an no right to be admitted. The only country that U.S. citizens have a right to enter and be in is the U.S.A., and the only country that Canadian citizens have a right to enter and be in is Canada.

With the amount of time he spends in Canada immigration was bound to get suspicious sooner or later, an it seems they are cracking down now. It's an unfortunate situation, but there is not much to do about it, except find some way to stay there on a more permanent basis.

Thank everyone for the advice. Guess we will have to try and work something out not sure what , because even if he applied for a job they harrasse the people that are offering you work , they did it to my brother inlaw he was guaranteed a job and immigration asked the employer why wouldn't he hire a Canadian they give him such a hard time the guy changed his mind about hiring him.

The employer has to show proof of trying to recruit Canadian Citizens or Canadian Permanent Residents (advertising requirements), and when none of these are eligible then that's when the employer can apply for the LMO for the foreign worker, your brother in law.
