BOWP - Questions

All,

I have a few questions on the BOWP visa. I am on open work permit which i obtained via my spouse who is on closed work permit. My spouse visa would expire in OCT - 2014 and the employer indicated that there would be no renewal. I am in a permanent employment.We have applied for PR this March - 2014 without the employer letter in CEC class.

I have the following questions :

1. Can my spouse apply for BOWP as we have a AOR number and if so can i be included too ? ie can we apply together ?

2. If the BOWP is approved and our PR gets rejected for reference letter .. can i apply for a PR on the grounds of perm employment via two things : 1. open work permit that i got via my spouse closed work permit (9 months) . 2. BOWP visa that i got via PR application of my spouse ( 3 months ) totaling 12 months.

My employer would give the reference letter but i would complete on 9 months to this Oct-2014 by the time my open work permit expires.

Please advise.

Yes. Your spouse can apply for the bowp and apply for both of you together in online. (You will be the dependent here)

Yes. You can apply for PR but make sure that your reference letter must carry the NOC code. Since you had both the permits as Open , so it wouldn't have been validated by HSRDC for NOC check for the position you held. Attach all the documents relevant to your work like paystub , T4 NOA , job offer etc., to ensure success in your final chance.

One Question - Are you going to continue with the same employer you currently working ? If no , try to get the reference letter from both of your old and new employers for your PR application
