Hi All,

I applied my PR in the month of April and I received my AOR.

Currently my work permit is valid till may 2015 but my project got cancelled and I need to return back in September/October.

Can someone tell me If I could apply for BOWP if I resign from my current employer (which would cancel my closed work permit with my employer).

Or let me know options to apply for BOWP.

To be eligible for a bridging open work permit, you must:

1. Currently be in Canada;
2. Have valid status on a work permit that is due to expire within 4 months;
3. Have received confirmation from CIC that your permanent resident application is eligible under one of the four economic classes (FSWP, CEC, PNP and FSTP), and;
4. Have made an application for an open work permit.

Unfortunately, since your current closed work permit expires in May 2015, the earliest you can apply will be Feb 2015. If you resign, your work permit expires as well and you have no status in Canada.

Maniac is right, you can't apply for BOWP for now but you can apply for EI while waiting for your PR.
Are you in the mining industry also? Our projects are also slowing down here in Toronto.

Not true! A work permit is also a temporary residence permit. The OP can resign and remain in Canada until the work permit expires. But he cannot work until he gets a new work permit.

Resigning does not CANCEL a work permit. A work permit is issued by CIC to the worker, not the employer, an employer cannot cancel a work permit.

I got my end date as end of August 2014 from my manager. If I resign from the company, then how could I be eligible for EI.
Can I use my end date as cause of my resignation.

If we consider that you are responsible for the loss of your employment, you may not be entitled to receive EI benefits. Here are a few examples of situations in which you may be considered to have been responsible for the loss of your employment:

you left your employment voluntarily and without just cause (you did not consider all the reasonable alternatives available to you to keep your job);
you were dismissed for misconduct (it was determined that you voluntarily or deliberately committed an inappropriate action, a violation, or professional misconduct); or
you are unemployed as a result of a labour dispute in which you participated, whether it is a strike, a lockout, or other type of dispute.

However, we may consider that you are not responsible for the loss of your employment if:

your employer ended your employment, but it was not as a result of misconduct on your part; or
you left your employment for reasons that could be considered just cause for leaving the employment (for example, harassment, discrimination, or dangerous working conditions).

In these cases, you may be entitled to receive regular benefits if you meet the eligibility criteria.
