BOWP, Implided Status, Leaving Canada Question

Hey Guys,

Quick Question, I am CEC Inland with LMIA AOR 10TH Feb.

Current LMO Runs out June 3rd. I have applied for a BOWP.

I have to fly to the UK from Canada on 5th of June.

I am assuming if my BOWP does not come through before I fly home, I will be on Implied status until I either leave Canada, My BOWP is approved or My PR is Complete.

I understand that if you leave Canada while you are on Implied Status, you cannot return with implied status.

My Question is, If I leave Canada and my BOWP is approved while I am out of Country, can I re enter Canada on the BOWP without any issues?

Also, If the BOWP is approved, before I leave Canada, Am I Ok to Leave and The Reenter Canada without any problems?

If you leave Canada on implied status and your BOWP is approved when you are away, you can't re-enter as a worker because you'd need the actual piece of paper at the border. A suggestion is to get confirmation of status as a worker before you fly back to Canada through the Canadian embassy in London. Check with CIC before you leave Canada though, just to be on the safe side, b ut I doubt you can re-enter as a worker without the physical piece of paper or some sort of confirmation of your status.

Ok Cool, Fingers Crossed it comes through before I Leave Canada!!

would I be able to re enter canada as a tourist on a 3 Month tourist visa and wait and not work, until i receive the BOWP?

I think you could re-enter as a tourist and wait till you get your work permit. I am 100% sure you can re-enter as a tourist, but am not 100% sure you can then wait and then get your permit. The reason why I am hesitant is because I know you have to remain in Canada for the duration till you get your work permit. So I would probably ask CIC just in case. I hope your work permit comes through before you leave. A bunch of us that applied early this year cancelled applications because our PR came through before the permit got processed, so CIC should have less applications to deal with now and the process should be faster.

Hi,

I'm in a similar situation.

I've just received my final language test results and can now create a CEC profile. I have had my 1 full year experience and all other requirements. I'm bilingual and hope to receive a nomination from Ontario though the French speaking stream. I have a Canadian Bachelor and I get about 430 points without the nomination.

Here is my quandary:

My current work permit expires July 2. Because I received my TEF results only yesterday (June 3rd), and therefore could not yet submit a CEC profile, I requested to extend my stay as a Visitor back in June 2 once my work permit expire (in order to respect the 30 days before expiration of my work permit, as mentioned on the CIC website. I held off as long as I could.)

I read elsewhere on this forum that I do have a chance to obtain a BOWP in my situation. I would have to submit my CEC profile, probably wait as close to the expiration of my work permit as possible before submitting a BOWP paper application, which could give me enough time to receive an AOR while my BOWP application is being reviewed. If all goes well, I actually obtain my BOWP. This seems to have worked several times in the past for other people.

The second parameter is that I have applied to Law Schools here in Canada, but am unfortunately still awaiting the reply of most them (Waitlisted where I want to go)! So, although I hope to start studying law in September 2016, I still have no certitude that I will be able to do so. If I were to do so, I would need to apply for a study permit I believe.

The third parameter is that I would really much like to go home this summer. Although this parameter sounds more flexible than the others, it is very important to me that I am able to do so if at all possible.

Here are my questions:

1) Could my application to extend my stay as a Visitor (whereas I had a work permit) jeopardize my future BOWP application? (Granted I may actually obtain the latter.)

2) Similar to OP, could I leave Canada once I have sent my BOWP application and yet be able to return and wait for that BOWP to come through? Or could I have a representative in Canada send my BOWP via mail to my home country? The variation, as compared to OP, is that, once home, I may actually be able to apply for a study permit (the worst part being that I do not yet know), so that I could return either as a visitor or as a student. Would my BOWP be cancelled, however, if I obtain a study permit? (Which wouldn't be that big of an issue, since I would be studying anyway).

3) Should I just stay in Canada the whole way through, granted my application to extend my stay as a visitor is actually accepted? (The downside is that, in the event I were to apply for a study permit, the processing time for such permit is 8 weeks from within Canada and only 2 weeks from my home country. If Law schools leave me hanging until late July/August, this may become a significant concern.)

4) Should I instead apply from home directly, abandoning the BOWP project and hoping Law schools take me in to apply for Study permit? Also, could someone confirm that I do not need to remain in Canada while my CEC application is being considered? I do have a representative (which I will register on my application) here in Canada that can physically be present on my behalf if anything happens.

5) How would PNP application affect the deadlines with respect to AOR/BOWP problem?

To summarize, I am trying to have as many options available to me as possible, in case either my BOWP doesn't come through, or I never get into law school. As you'd noticed, I am also trying to cram all of these in a ridiculously short time frame with very little room for error.
