Hi everyone,

Hoping you can assist - starting to get very stressed about this.

I have applied for PR under the old CEC process. My current work visa is expiring on October 22nd. I am applying for a BOWP until a decision is made on my PR but I have just been informed that my spouse is not eligible for a BOWP as she is a dependent on my PR not a principal applicant. My PR should be processed shortly (fingers crossed - it is pending for 24+ months now). The paper processing time for PR is 111 days currently and that should provide enough time for a decision on my PR.

I am wondering if I apply for a BOWP for my spouse would she qualify for implied status until a decision is made? Even if I know the application will be declined?

Any assistance would be appreciated.

Thanks.

Your spouse is not eligible for BOWP, but she is eligible for OWP as dependent of PR applicant (BOWP holder). You can apply for work permits together.
