Born in canada but parents returned to the UK

Hi

I was born in Canada in 1958 to British parents who returned to the UK when I was still a baby.
My husband has the chance of a job in the USA just over the Canadian Border,
1. can I apply for Canadian citizenship
2. Can I sponsor my husband
3. Can he work in the USA but reside in Canada?
4. If either of my grown up children decided to come over could they apply for Canadian citizen through my birth?

1. You need to apply for proof of citizenship, see http://www.cic.gc.ca/english/citizenship/proof.asp It takes a long time to get it but if you tell them you need it expedited because you are moving to Canada, you can get it faster.

2. Yes, you can sponsor your husband for permanent residency. As a citizen, you can do it while you are still living in the UK if you provide some proof that you will be moving to Canada when he gets his PR.

3. He will still need a work permit to work in the US, even as a Canadian PR. If there are no conditions on his work permit stating that he must live in the US, then there would not be a problem for him to live in Canada and work in the US. He would probably have to file taxes both in the US and Canada though.

4. As you were a citizen at the time your children were born, they may well have a claim to Canadian citizenship. You can use a self assessment at http://www.cic.gc.ca/english/citizenship/rules/index.asp and they could apply for proof of citizenship at the same time as you do.

The OP doesn't require proof of citizenship as she has a Canadian Birth Certificate, which makes her a Citizen unless her parents were diplomats. She has to apply for proof of citizenship for the kids though.

Thanks for the replies...kids probably won't be an issue as they are grown up and independent. I saw a blog that said just because you were born in Canada it doesn't give you the right to live there.. but it was an old msg. And I haven't lived there for a very very long time. I have lots of family out there still, aunts and cousins etc..
Re hubby - no he doesn't have to live in the US for the job as it is in Detroit and only a short trip from Windsor as long as there are no problems with customs going back and forward each day.

Being born in Canada is a proof of citizenship in most cases, that is unless you gave up citizenship or your parents were foreign diplomats or some such. You can definitely go to the embassy and see if you can get a Canadian passport just with your birth certificate. You might not need a citizenship certificate at all. As for your kids, if they can have dual citizenship, why not? They might not want to move to Canada now but if they do later, they could already have it sorted.

Note though, you spouse does need an H work visa for the US whether he lives in the US or not.
