My son was born in Kansas and I am Canadian, making him a dual citizen. After some issues of domestic abuse with his father, the county court allowed me and my son to return to Canada without any issues from his father. This was in October 2012. In February 2013, we finally received final order here in Canada for sole custody with no access granted to my sons father. We have plans to travel to South Carolina to visit some family this summer.My question is: what will I need to ensure that he will be allowed into the United States with me, and allowed back into Canada? Are the custody papers enough evidence to prove that he is not being kidnapped? I have no contact with his father so it is impossible to get any sort of letter from him allowing the travel plans.

I would suggest contacting both US and Canadian border authorities directly to confirm directly with them if the sole custody papers are enough. They might possibly request a notarized letter stating that because of the domestic abuse issues, you don't know where he is and the child has zero contact with him. But definitely contact them to be 100% sure what you need to do.

A copy of the custody papers giving you sole custody is sufficient.
