Question: A friend of mine (CDN Resident) married a woman from SE Asia. He sponsored her into Canada thereafter successfully. His wife, after 2 years in Canada left him for another Man in Canada. She has since married the new Man. I ask this question for my friend....can he legally have his ex-wife deported back to Malaysia?
 
No, he can not have her deported. If he believes that she committed marriage fraud, he can make a complaint about her to immigration but if he has no proof and she stayed with him for 2 years after she arrived in Canada, it is very unlikely that anything will happen.

There is currently a new rule about sponsorship stating that if a couple has not been together for 2 years at the time they apply for sponsorship, the PR is conditional based on them still being together 2 years after the sponsored spouse arrived in Canada. However, this is a recent rule change and it is not retroactive and even if it was, since she stayed with him for 2 years, she would not be affected.
 
Your friend should just move on.

I agree with Leon. There's no chance his ex-wife is going to be deported given the circumstances.

Why did she re-marry??
Both parties are to be heard for a fair opinion.
 
Thanks for the input everyone. Not sure why she remarried. Her new Husband is very well off financially however. It's women like her who make it difficult for honest people to enter Canada under a Spousal sponsorship.

It kind of makes sense sadly:

1. She uses a person to come to a developed country, (golden goose husband/sponsor whether rich or poor)
2. Leaves the person who originally sponsored her (because she dosent need him anymore)
3. Marries someone who is well of financially (money gives you options)
4. She gets the best of both worlds, living in a developed country and marrying someone who is financially secure.... tada :)

There are plenty of men who do this too.
 
that would be a NO. Seem this happened before. Nothing he can do about it.
