Girlfriend and I have been dating for 18 months. She is not a skilled worker. Our plans were that she move up in January and us get married in May. Is there anyway that she can stay in Canada during this process? She would like to go back to NY probably once a month to visit 19 year old son.

What would be our best plan of action?

Thanks for any help

hello,
where do you plan to marry in the US or Canada? You can file sponsorship for her right after marriage. Yes, she can travel back to the US each month, but every time entering Canada she will have to prove that she doesn't intend to overstay.

well, then she can probably hang out with you and visit pretty much as often as she wants but she won't be able to work...

Our plan is that she moves to (visits) Ontario in the new year.

I'm trying to get this all straight in my head so that I can reassure my girlfriend as well.

She will have quit her job and given up her apartment. She will be able to stay with her parents when/if she goes back. She does plan on returning at least once a month to visit her 19 year old son. She is waiting on her divorce to finalize and we will be getting married shortly afterward in New York state.

Pre-marriage queries;

So when we cross the border what does she tell the IMO, that she is coming for a visit? Does she tell them that we are planning on getting married? We understand that she must agree not to overstay the time granted. But, this can be extended if she wishes either by recrossing or sending a letter? I doubt that she would extend it by letter, as she/we will be returning monthly. How long does the stop at the border usually take?

Post-marriage queries;

Once we are married and I have filed sponsorship application, will she be able to remain in Canada? The monthly trips will continue. She has cash and I am able to support her as well.

Thanks in advance

Wally

This part is a bad idea. If she has no ties to the U.S., it looks more like she's moving to Canada rather than visiting, and she may get turned back.

From what I've read a outland application is best.
