Before I apply, a question of concern (NOC 5241)

Thanks to this board and its members that most of my questions regarding the application for immigration have been resolved. I am on the verge of sending my initial application to Nova Scotia but first a question that begs an answer:

I am an academically qualified graphic designer and now working as a consultant in a major IT company in India. My work experience/profile matches NOC 5241 in large (Skill Level B of Technical Occupations and Skilled Trades) and partly in NOC 0231 as a consultant/manager (as you'd know NOC 5241 doesn't come in the 38 Ministerial list of occupations but NOC 0231 does). My total work experience is 12 years, having spent the last 5 years of it in the same company. Do you think I will face a problem here? if yes, then what's the work around. Many thanks in advance.

Edit: I've worked in Canada before for a short-term before and have a WP which will end next month. Just for your information.

As long as you have at least 1 year experience in the 38 NOC categories listed and also 4 years in the A,O,B skill areas, you will get the max. points.

Thanks a ton for your response, MarkCan :) Yes I have more than 4 years of experience in Skill B. Now to look for the 1 year experience in 0213. Let's see how it goes. Thanks once again :)

I don´t intend to be a party-pooper, but in order to qualify as NOC 0213, you have to have at least 1 year experience AND the duties that you have performed have to match completely or partially with what´s on the NOC for 0213. Also, and from what I´ve been reading on the various forums, it seems that NOC 0213 is probably the most sought after NOC...and the most rejected.

Nonetheless, if your confident that you have the experience, then go for it. If you get rejected, you'll get your money back.

Hi Fede. You're not a party-pooper at all. Those are valid suggestions and I am in total agreement with you. I am going for NOC 5241 but my duties have been somewhat matching with NOC 0213. I don't want to lie on my application and so I am applying for 5241. I am going to explain further about my role and responsibilities in a separate sheet and hope that'll convince the IO. Otherwise, like you said, I will receive my refund in full :)

If you apply to CIO Sydney with NOC 5241 in FSW1, it will be refused.

Hi PMM and thanks a lot for your comment. How should I present my application then? because somewhere NOC 5241 will be shown since some of the jobs that I did fall under this NOC. What's the work around? And why do you think it would be rejected.

Because that NOC is not in the list of 38 eligible for processing for FSW1 http://www.cic.gc.ca/english/department/media/backgrounders/2008/2008-11-28a.asp

Hi PMM - your point is well taken. What do you think I should do in this situation? in the Indian context of the IT industry the roles are not siloed -- we have to do certain things outside our domain too. In that sense if I had to play a designer's role, I cannot lie on my PR application.

Between 1999-2008 I complied with responsibilities that match NOC 5241. However in the past year or so I have been partially matching the role and responsibilities from NOC 0231. Do you still think it's a tough ask for me? please let me know.

Yes, you will need to show at least 1 years experience in 0213. You have to have performed the majority of the duties of the NOC for that whole 1 year period.

Hi PMM and thanks for your valuable inputs. I will have to prove that I have been performing some or all of the duties outlined in NOC 0213. That's also pretty much what I had in my mind :) Thanks so much once again and I am hoping that you and the others will be always around when I need assistance :)
