Been in Canada since 1999 - TWP just got refused...please help!

Hi Everyone,

A brief background before I start:
- I am a UK citizen
- First came to Canada under a student visa to attend private school from 1999-2003 - granted
- Graduated high school in 2003 - applied for new student visa for university - granted
- Attended university in Canada from 2003-2007 and received a Bachelor of Commerce Degree
- Applied for Post Graduate Work Permit in 2007 after receiving a job offer - granted for 3 years
- Applied to renew work permit with same employer in 2010 with positive LMO - granted for 2 years

- Applied to renew work permit one month before expiry - received letter of refusal because I didn't submit a recent job offer letter from my employer that I have been with for 5 years. I have stopped working as soon as I received the letter. I guess I made a mistake thinking I didn't need to send a new job offer letter. I'm also not sure why CIC didn't make any attempt to contact me as I would have been able to quickly send a new offer letter to them.

Here are my questions:

1. Seeing that I already have received a positive LMO back in 2010 - I assume my employer can apply through the accelerated LMO process. I noticed the Toronto office has a fax number. Can it be submitted via fax?

2. Does my employer have to show hiring efforts prior to submitting the A-LMO? Or can it be done while the LMO is being processed?

3. In the meantime, am I able to apply for restoration and a new work permit while waiting for the LMO?

3. I've been reading a lot about "flag polling". If I receive a positive LMO along with my new job offer letter, can I attempt to flagpole even though I would have applied online for a new work permit / restoration? With my background and long history in Canada, what would be the chances of getting denied?

I'm feeling really nervous about the whole situation as I've never had any issues with immigration applications in the past. I have all my documentation ready to apply for permanent residence under the Canadian Experience Class, but cannot do so until my status has been restored.

Anyone's help with this is much appreciated.

2. not familiar with the A-LMO process - read up on it.
3. You may, but it will be rejected if you don't include a LMO file number at minimum, plus, you will be out $150 + $200. Note that you have 90 days from the refusal letter date or work permit expiration date to apply for restoration + new work permit.
4. As you are from a visa-exempt country(UK), you can go to the border with your LMO, job offer, etc and apply for the permit there If you have everything you need, don't see why it would be denied.
5. You graduated in 2007 - how come you are yet to apply for permanent residence?

Unfortunately, CIC is not obligated to contact applicants for more information. Some officers are lenient and will make a request for additional documents, others just make a decision based on information in file at the time.

Yes, you should have submitted a recent offer and a new LMO, since the one from 2010 was good for 2 years(2010 - 2012).
