Hi Drooza and Arlnr
Sorry to hear about your case. It sounds strange that the Canadian immigration system declares one rule and implements something else. If the immigration system wants the prospective lecturers high IELTS score, they should publish it before so that those who have xx IELTS score can only apply. Is there any rule that the prospective lecturers should secure xx IELTS score? I am sure not, then why should applicants suffer due to such flaws in immigration system? I am working in English speaking country for last 4.5 years and was not proficient in English when I joined this company. I didn't have much problem working here. I have seen many foreigners (mostly doctors and engineers from non-English speaking country) working here and nearby English speaking countries, and most of them have only basic knowledge (may be IELTS score-4 or less) of English and doing well. I do agree that, one can do wonders if he or she is proficient in English, however if you are not proficient in language "you will find your own place accordingly". You may not be promoted to CEO or manager level if you do not have command over English, its ok. Let the time pass, may be in next 4-5 years you will be thorough. Now you already got the "punishment" for not being promoted due to lack of fluency- and when you are ready to suffer and face the situation, what is the problem with the VO? And what happens to the immigration rule? you show them the dustbin whenever he(VO) wishes?
Survival in Canada is our problem and not the VOs. One more strange thing I came to know that if your relative in Canada is not well economically established - you can't get the 5 points!? Where is such rule. Shame on Canadian employers and government who do not recognize degrees from other countries including US and UK. Applicants are eligible to migrate on such degrees and experience and when it comes to employment they are "Illiterate". If Canadian government is so worried about our settlement in Canada why don't they change the rule and sue the employers who discriminate against accredited foreign degrees and experience?
Friends, in such a difficult situation what you need is a good lawyer, to show them the "rule of the book". So Drooza, hire a good lawyer, like what Arlnr did and fight for it. I am sure you will get through. In the interim, I advise you to go for IELTS and try to get the good score and if you cannot succeed in getting good score, still you have a valid point to fight-"Rule of the book" and nobody can deny that. I don't think, in such a stressful situation and in such a short period of time both of you can improve your IELTS score so much.
Trust in God. Submit yourself to will of God. Please him with your strong prayers and good deeds. Only He can do miracles and miracles ALWAYS happen with BELIEVERS. Month of Ramadan is nearing (since you both belong to Muslim countries). "Fast" in Ramadan in real sense- means no lying, no fighting, no backbiting, no cursing. Give donations to poor and needy people, feed them, and make dua for them and for whole humanity. Make dua for other people first, help them to solve their problems, ask Allah to solve their problems-then your problems will be automatically solved. And after doing all this, whatever happens with your application, accept it as Allah’s will and be happy.

May God bless you and take you out of this situation at the earliest.
