if a client got 67 pass mark then why they r asking explanation that how can i establish my self in canada although i have got 69 out of 67

Secondly if a relative is in social assistance then why they r thinking that my relative is not capable to support me at the initial stage in CA

it should be mention here that every client should fulfill their economic solvency for at least 6 months as a POF and there is no need to support from relative
Only 5 points from relative nothing else
then why they assume as dependent to relative

I am asking all of u because of this

Pls advise me about the unexpected....................
what can i explain about this unexpected matter pls advise and it should be submitted before August 03 2010 though i am waiting for medical

Mr. Islam,
This refers to your application for permanent residence in Canada.
Although you have obtained 69 selection points, I am not satisfied that these points accurately reflect
your ability to economically establish in Canada. Therefore, I am considering refusing your case
using negative substituted evaluation for the following reasons:

a) With basic writing skills and moderate listening, reading, speaking skills (per IELTS)
I believe you will have difficulty finding employment in Canada as a vocational instructor
(the field of your declared work experience) or in a related field;

b) Mohammad Jahagir, your uncle in Canada, has clearly not economically established there
as he has been unemployed since returning to Canada in July 2009 and he is (per 2009
T5007) collecting social assistance in Canada. Therefore, I am not satisfied that your uncle
will be able to significantly assist you in becoming economically established yourself.
This is a procedural fairness letter giving you an opportunity to respond to this information within
60 days from the date of this letter before a final decision is made on this case.
Kind regards

I agree with both what Jnathan and Drooza says. Show that you paln to take an english language course and do IELTS.

The whole reason for the point system is to see whether you can become economically established in Canada. I think that is why they give points for family as they can help you become economically established. So while your uncle may not have anything to do with your ability to become established, then that would preclude those points. I am not trying to be mean but trying to show that you need to address their concern. Good luck.

Dear alnr;
Really sorry to know abt ur case. Regarding ur points query, if u go through OP-6 (Operating manual of FSW) u will find this information at page 43. It empowers VO to decide against applicant even if he or she scores 67 or above points. So what others are suggesting u is right, dont go into a negative or resistive mode. Focus on IELTS, Inshallah u will receive positive Evaluation.

Substituted evaluation
R76(3) makes possible substituted evaluation by an officer. This authority may be used if an
officer believes the point total is not a sufficient indicator of whether or not the applicant may
become economically established in Canada.
Substituted evaluation is to be considered on a case-by-case basis. The scope of what an officer
might consider as relevant cannot be limited by a prescribed list of factors to be used in support of
exercising substituted evaluation. There are any number and combination of considerations that
an officer might cite as being pertinent to assessing, as per the wording of R76(3): “. . . the
likelihood of the ability of the skilled worker to become economically established in Canada. . . .”
OP 6 Federal Skilled Workers
44
2010-04-01
Frequency of use will vary from visa office to visa office, as some will find in their caseloads more
situations of disconnect between the point total and establishment prospects than will others. The
fact that the applicant “almost attained” a pass mark is not, in itself, grounds to recommend the
use of substituted evaluation. Rather, the officer needs to identify and document the facts
demonstrating that the points awarded are not a sufficient indicator of the applicant's ability to
become economically established in Canada.
For legal clarity, officers should employ the terms used in legislation, such as “substituted
evaluation” or “ability to become economically established.”
If an officer decides to use
substituted evaluation when …
Then the officer will …
the applicant did meet the pass
mark (i.e., negative substituted
evaluation)
• communicate their concerns to the applicant and provide
sufficient opportunity to the applicant to respond to these
concerns, through correspondence or an interview;
• obtain written concurrence from a designated officer.
the applicant did not meet the pass
mark (i.e., positive substituted
evaluation)
• obtain written concurrence from a designated officer.
Substituted evaluation is not to be confused with humanitarian and compassionate aut

Hi
I am going to consult with a lawyer and prepare this for consultation
Pls adv me

After a long waiting Q This is really frustrating for me now, I am indicating some of my opinion to u for further procedures

Is it a common practice after obtaining 69 marks out of 67.

Is there is any probability to deduct my relatives point.

Previously they ask my relatives documents only ( On early April 2010).

Why not then point out the language factor.

Why they suppose to predict some individuals future in CA in reference with IELTS and others
after obtaining 69 selection point

There are lot of skill / Language development program runs everywhere throughout CA for New Immigrant then why they are assuming that there are no further development in that specific field.

They have organized such type of programs for the sake of new Immigrants, ultimately options are open for a new comer to build himself best in Canadian economy.

You know Now a days Every new Immigrant engage them self in such type skill development program because in the real life there is no suitable jobs available without Canadian experience or degree and it is common for all like doctors , engineers, It people etc.

And my relative is suffering now for this reason , you know he is completed his education from Michigan University USA though he has no positive result in job factor in CA because Lack of Canadian experience.

So further skill development is must in CA for new comers economic solvency.

Now come to another point which is economical support from relative.

In that case I do not need any financial support from my relative because I have my own required fund if that is not enough then I will have to submit more.

The main objective is only the 5 points for relatives residing in CA.

It does not mean that he is sponsoring me or I will be depend on him.

Because w are in FSW class Not in Family Class Sponsorship. ...

I empathize with you. I think the purpose of those 5 points is an indication that your family member can help you get economically setup in Canada. This might be the reason. I am really sorry to hear this happening to you but you should really try convince them. It is in their legal right and I am sure they have rightful concerns about immigrants.

They are going to wonder how he got the 30k so fast. The problem is that they know different tricks people might try to boost their PoF and even if the OP is legitimate, convincing them would be hard. Maybe showing 30k with 6months of bank statements in his accounts will help. Of course, i am guessing. I am no expert.

IO might think but he might make arlnr to take that whole amount with him if he grants his PR. So arlnr needs to fix his mind according to that.

I meant OP not IO. Yep, they may expect him to take it, but making it to the final PR is the main issue. Anyway, I don't think the extra money is going to make a difference as much as IELTS. Thats just an opinion.

I believe they picked your IELTS score because your NOC is teaching related and it requires more communication skills than other professions. If you improve IETLS and get total point (including relative points) 67 + 5 = 72, so that you can qualify even without your relative points. That way you can address both relative points and communication issue.

Write up IELTS ASAP so that by time you send your response you also have your updated score.

Best of luck
