hi everyone, please give me advise or suggestion what can i do next? im live in caregiver under new pathway, i came here sept of 2016, but i got illegally terminated due medical reason ( i got injured while on duty). my doctor gave me a medical modification certificate to lessen my work load, because i need physio therapy that time. instead of helping me they terminated our contract, and they never help me on my medical expenses. im just alone here in canadaa away from my family, while waiting for my new job im volunteering in food bank and community church for me not to think too much and i can use my time helping others, i found a new employer but suddenly after 6 1/2 months of waiting they refuse to process the lmia, then i tried to apply a new one, most of time i got rejected because of my situation, i found a new employer again but suddenly while waiting for the work permit they back out to hire me, then now im out of time to find another one, its hard because it takes 6 to 9 months or more for the application of working permit. its not my fault to lost my job at the first time. actuallu i have agency here in canada but she’s a best friend of my former employer, after i paid her a thousands dollar she cant help me. im too my exhausted and i cant even help my family way back home financially. i came here in canada to work.

the question is? am i illegible to apply H&C or Can i apply PR under our program which is childcare categories ( new pathway) 1 year full time work T4 + EI sickness T4E. do you think the immigration give me a consideration on this kind of situation? i passed my english exam already and my educational reqs. Thank you so much. TIA

You do not qualify for the new pathway program. You must have at least two years of full time paid work experience. Your time spent on EI / sick leave will not be counted.

H&C has low approval rates and your case is not strong. Rather than applying for H&C, I would recommend you either try finding a new employer or make the choice to return home. If you decide to apply through H&C, you should be aware that the process often takes 2 years to complete and if you are refused, it will be very difficult (likely impossible) to return to Canada in the future on a work permit. You should hire a good lawyer if you want to try applying for H&C - you should also be prepared for the high probability of refusal.
