hi all, I am currently living overseas with my husband but we want to move back to Canada. Are we allowed to come to Canada with him as a visitor from Australia and apply inland? Like when we arrive in Canada is it ok to explain that’s our plan? Or do they discourage that? Also, do I need to provide Canadian tax statements showing my ability to sponsor him? I admit I haven’t filed taxes in Canada in five years while being in Australia, working here. Will that be a problem?

If I recall correctly, your husband has or had a criminal history. Senior members highly recommended you consult with a lawyer about his chances of coming to Canada. If you haven't done that, I would suggest you still do that.

Regardless of the outland or inland application, I believe he will still need to go through the appropriate criminal record checks to be approved. To put it into context, a friend of the family was planning on sponsoring her partner to move to Canada from the US, however the PA had a DD charge (not a conviction) and was deemed inadmissible to Canada.

Food for thought, I suppose.

No, he can't just come as a visitor. The only possible way he could come to Canada prior to being approved for rehabilitation is if he got a TRP.

Even if he is approved for a TRP and comes to Canada, he remains criminally inadmissible and you will not be able to sponsor him until he is approved for rehabilitation, which will be 2024 at the earliest. There is pretty much no chance he would be able to continually extend his TRP in Canada for that time, so expect long-term separation.

If you wish to remain with him, you really should be focusing on making a life in Australia for at least the next 5 years and hope that he doesn't screw it up again.

He still hasn’t gone to court for the dui, that’s coming up soon. We are hoping for a miracle that his lawyer can get him off but it’s unlikely. Just weighing all options at this point if there even are any. I’m so depressed here in Australia and need to go home. I love my husband but hate that he has caused this horrid mess and I’m heartbroken leaving him but I think I have to :(
