To Whom It May Concern:
Hi everyone i received a letter from Officer in Vancouver an Approved in Principle last November 14,2016 and i am a little bit confused what to do next. I am an Inland Commonlaw Family Sponsorship process. My question is do i need to gather a security check and medical for my family in my home country Philippines.? Even if i didn't include them yet on my application.
Here is the letter i received from the Officer.
Dear XXX,
This refers to your application for permanent residence as a member of the Spouse or Commonlaw Partner in Canada Class.
It has determined that you meet the eligibility requiremetns to apply for PR status under this class. However, a final decision will not be made until all remaining requirements for becoming PR have been met. These requirements include medical, security and criminality checks for you and, if applicable, all of your family members both in Canada and abroad, even if they are not applying to join you in Canada at this time. You cannot become a PR until you and all your family members have met these requiremnets.
A sponsored spouse, common- law or conjugal partner whose application for permannet residence was received by IRCC on or October 25,2012, is subject to period of conditional PR under section 72.1 of Immigration and Refugee Protection Regulations ( IRPR) if they were in relationship with their sponsor for two years or less and had no children in common with their sponsor at the time of the sponsorship application.
Section 72.1 of the IRPR states the following:
72.1 (1) Subject to subsections (5) and (6), a PR described in subsection (2) is subject to the condition that they must cohabit in conjugal relationship with theri sponsor for a continous period of two years after the day on which they became a PR.
IRCC has determined that you are subject to the condition under section 72.1 of the IRPR and therefore you are required to live together in a conjugal relationship with your sponsor for a period of two years after the day om which you become a PR.
