Applying Outland in Canada

Hi,

I'm flying to Canada in October with my husband in hopes of applying for the canadian spousal visa (outland is possible, if not inland). Would I be able to enter on a One-way ticket (which ive already booked) if I explain im applying for a spousal visa and show them i have enough money for a return ticket if i were to need it, and proof of his parents letting us stay with them. Would they even ask about any of this? I would also have alot of the paper work for the visa with me too. Just wondering how to go about this without being denied entry etc.

It's typically far better to have a two way ticket (both for flying and entering Canada). I would verify with the airline that they will allow you to fly with a one way. Sometimes airlines will refused boarding to individuals with one-way tickets since they don't want to get stuck with funding the return airfare in the event that person is refused entry into Canada.

I'm flying with Icelandair and I just looked, couldnt find anything saying you couldnt travel with a one way flight - though i will confirm this with them. I'm more worried about Canadian boarder not liking it and not letting me in if i'm intending on applying for a spousal visa.

bring copies of everything you have done so far for the application, and your marriage certificate. if it becomes an issue, more likely than not they will give you a visitor's record, specify a date you have to leave by, and possibly require you to "check out" with them before you leave. as you are not a citizen or pr and do not have a work or study visa, you don't have the right to "live" in canada. never say "live" or "move". at this point you are only allowed to "visit". if you can pay a portion of the fees beforehand, that helps show intent. generally with visa exempt applicants, they are happy to see you know the rules and are doing your best to follow them.

no one will be able to say for sure what will happen when you meet cbsa. whether they will be concerned with you not having a return ticket is dependant on the agent you meet that day. just be prepared, answer the questions they ask and you'll be fine.

Would this still be an issue if i were to apply inland? Since, as far as i've been told, once you apply you have implied status in Canada with the OWP.

no... if they think you plan to stay there indefinitely they will for sure refuse you entry. visitors do not come to canada to stay indefinitely. visa exempt visitors can visit for 6 mo, and then need to apply for an extension of stay in order to be in canada longer.

where are you from?? It is ONLY recommended to apply inland if your visa office is taking OVER 1.5 years to process. Currently, inland processing is stuck on July 2013 applications. If you're visa exempt, then it's best to apply outland. You would most likely LAND as a pr before an inland OWP is ever approved.

I'm from the UK. I was given the impression that you could go to Canada and apply for the inland visa and once you've applied you werent really allowed to leave again until it was processed. If i were to have a return flight im guessing they wont really have a problem with me coming into Canada and applying for the visa?

the inland application isn't for people to go to canada as a visitor, so they can apply for PR and wait for approval to do anything. It is for people who are already living, working, or studying in canada and want to apply for pr. Or it's for visitors who require visas to enter canada and the outland process would be significantly longer than applying inland.

You are visa exempt. there is no reason at all to apply inland right now. I dare you to go on the UK or Inland applicant threads and ask which is best to do. you can certainly enter canada as a visitor and apply OUTLAND for pr, and stay there for the process. The only drawback is needing to go home in the slim chance an interview is called. i believe for UK, the interview is waived in a majority of applications.

Ah ok im sorry i must have had that wrong. I think the best idea maybe is too book a refundable return flight, refund it once we apply for the visa and extent the stay in Canada. Is there a maximum of times you can extend it (assuming its 6 months every time). I think the outland is currently taking about 9 months or so, so i would need to extend it at least once as a visitor.

generally people ask for 12 months and it's rarely denied. i've heard it recommended to ask for 18 months. not sure if anyone's actually tried.

Ah ok thats great. Thank you again for clearing this up for me - I think i shall book that return flight just to cover my butt.
