Hi,

My husband and I are applying for him to immigrate from South Korea. However, he is American, we are living here essentially to save up money for this process and for when we get back to get set up. We have not applied yet but will in the next four months.

As for the region specific forms, should we be filling out the forms for the USA as he is American or forms for South Korea?

I am wondering if there is anything different we have to do because we are living here at the moment. He will still enter Canada as a PR from the United States as we will go back there for about a month before we head for Canada.

Any advice would be really appreciated.

Thank you!

You will need to use South Korea's regional forms. As he is from the US he will need to order an FBI clearance which can take up to 3 months to get. Mail at least 3 sets of fingerprints so they have more to work with and hopefully won't refuse them due to low quality prints. Also, do you plan on staying in the US or South Korea? My concern would be that if he is planning to go back that he should just apply through Buffalo instead. That way if he is called to an interview he just has to fly there but if you are still applying through South Korea, he comes home to the US, and then they want an interview, he will have to fly back there. Also, somes countries when you apply through their office and aren't a citizen can scrutinize you more so heads up for that. And he will need a clearance from South Korea. If you aren't going back home when you first apply then you will need to provide proof that you plan on going back home and residing in Canada then you can update them later telling them you are currently now residing in Canada and provide proof of that. Hopefully this helps you some and that you also get some more help from others. Good luck!

We plan to be here until at the earliest November, the latest February. We plan on applying from here but returning to the States to visit family for a month before permanently going to Canada.

Thanks for the info about needing to prove we will be returning to Canada and have a plan to re-establish there.

We don't want to wait to go apply until we go back because I can't work in the States so we'd be sitting ducks for as long as it takes to process. So, South Korean forms, good to know, thanks for the info! I appreciate it and any other advice, a lot! :)

Well, if you're going back to the States, why not apply through Buffalo? He is a US citizen, he can have his application processed through Buffalo, as that office is responsible for US citizens. Also, if he applies through South Korea and an interview is required, you do realise he will have to go back to South Korea?

Additionally, I don't know what kind of processing timeline South Korea has, but they'd have to be pretty fast to beat Buffalo's average of 4-6 months for straightforward cases (I know I can look it up, I'm too lazy right now).

Just my tuppence.
