I'm wondering if anyone has submitted a TRV application (single entry) while waiting for spousal sponsorship to be approved?

My SO was denied X2 last year for a visit. Both were submitted one after the other (the only reason why was cuz their reasons I felt were not valid for declining him so I wrote another cover letter and added some additional information and they still denied him)

Just wondering if we should submit again or not. We just want to return to Canada for 1-2 weeks in the summer for my brothers wedding. We have the invitation and we both live in Mexico full time. It's been a year since the refusal.

Any thoughts? I don't want this to slow down or jeopardize our sponsorship.

Some forum members have reported they successfully got a TRV after applying for a PR visa. They included proof the sponsor was approved and the PR application sent in and paid for. Of course, many others have been unsuccessful. With two refusals already, the visa officer will notice. As long as all attempted visits were to visit you, it should be OK.

An Iranian from the Damascus forum got a temporary resident visa from the Ankara office last month after waiting 17 months (3 months past the 80% waiting time) just by showing up in person with his wife and asking.

My fiance was just denied a visitor visa yesterday even though a year ago he had a trv and traveled well within the confines of the visa. We submitted EXACTLY the same proof. I would have thought he would be a shoe in for another visa with the same proof. So before yesterday I'd say, Yeah go for it! Now I say, think long and hard.... Yes I'm bitter and really annoyed that they don't even give the applicants the courtesy of talking with them face to face or even writing a PERSONAL letter of denial. If you've got the money, sure why not, but if that money could be used for something else important, save your money.

Tink :( so sorry to hear that, that makes no sense @ all!! I really do not understand the process of issuing visitors visas - it truly makes zero sense. One person can get accepted with little to nothing holding them to their home country and another with a lot of proof and evidence is declined.

It is indeed a gray area contingent on convincing a person you won't overstay (in the short term). As you build your case, it may help to read up on the rules on dual intent http://www.cic.gc.ca/english/resources/manuals/bulletins/2009/ob131.asp

Read the whole thing, but a couple of selections follow for easier discussion in the thread:

"A22(2) states: “An intention by a foreign national to become a permanent resident does not preclude them from becoming a temporary resident if the officer is satisfied that they will leave Canada by the end of the period authorized for their stay.” Dual intent is present when a foreign national, who has applied for permanent residence in Canada also applies to enter Canada for a temporary period as a visitor, worker or student. Dual intent on the part of the applicant is therefore not prima facie grounds for refusal of temporary resident status."

"An applicant applies for a temporary resident visa (TRV) to visit Canada but is denied solely because they have a family class application for permanent residence in process. In the refusal letter, the officer states that because the applicant is pursuing permanent residence, the officer is not satisfied that the applicant will leave Canada at the end of the period authorized as required by A20(1)(b). The officer has made an error. A22(2) precludes denying an application for temporary status on the basis that there is an outstanding permanent resident application, if the officer believes that the applicant will leave Canada at the end of the period authorized for their stay. If the permanent resident application is finalized after the issuance of the TRV, the applicant would be authorized, on the basis of the permanent resident visa, to remain in Canada."

Without raising your hopes at all, consider writing a letter to the program manager at the visa office asking for reconsideration laying out your case and referincing with any additional proof you may have you could provide and faxing it or sending it as a case specific enquiry after reading my post right above this one. Or, having the Canadian go to the Embassy if you are close enough to make it reasonable.

Thank you both.
Is it really possible to do that? Because in the letter they pretty much say, screw off, in a nice way, but if we wish to reapply just give them the money again.
I'm the Canadian. The visa office is a 4 hour bus ride away. I think we'll discuss it and I'll see what I can find out.
Thanks for your input. I'm still very bitter and I think we need to at least wait until we (mainly I) have cooled down because I kind of just want to tell them exactly what I think of them at the moment, but we all know that will only lead to trouble later haha.
Regardless we would have been upset over a denial, but if they weren't so cold about it and there was the ability to have an interview or talk with a visa officer we'd feel a little better about it because right now we get the impression that they didn't even look at the additional proof we had submitted, just the application, and who knows if that was even read through entirely.

I'll read your link and check into this. Thanks for the suggestion.

i have done it! in fact, i still have a valid visitor visa until 2013 with multiple re-entry and at this moment i am just waiting for my PPR for my PR. I believe you just need to convince them that you intend to go back and you have a very valid reason to go back to your home country.

i think it depends on many factors itscoezy (male/female applicant, ties with Mexico, economical factors, etc) we also were denied; i think 3 times we re-applied - first time i took it as smthg easy, like u just need to apply and u get it, we had all the proofs they asked and it was really a shock for me just plain rejection without even an interview; 2nd time we prepared well - show more intent of return, ties with the current country, etc same result; i honestly think once they decide in a way it's very hard to make them change their mind; we were refused in the same day so i don't think they even looked over the new proofs (in the system it just popped the old answer and it was like thank u come again)....so if u started with denial u have a much more steeper way to go....3rd time our situation changed 2 improve our chances (or so i thought) and again surprise the same refusal reason

all this happenned during a longer period of time...we didn't really apply straight away again....also during all this time i was outside Canada with him and still am, i had proofs that i won't stay in Ca either and still nothing ::)

tink i'm so sorry i was really surprised when i knew u got it last year (happy but also a little jealous :p ) and thought i will ask ur tricks if we ever want to apply again....:( that's really strange, usually after a successful trv the rest should b successful too ::)

itscoezy at the end if u want to apply apply, it's like the lottery: almost impossible but some people do win ;)

Itscoezy, you already know my story but I will add my two cents in here for others. My self and my SO are in are twenties. Last year on our first try he recieved a multiple entry visa. We did tell the truth and state that we were in a relationship and the reason why we wanted the multiple entry.

Here is what we submitted intially:

- Proof a business that he owned
- letter of explanation
- letter explaning why we wanted a multiple entry
- copy of my passport and some pasts trip I had taken to see him
- all requried documents
- already puchased plane tickets and return

Then we saw they asked for additional documents, so we emailed then and then submitted (within 10 days)

- proof of bank account
- lease agreement of property
- proof of ownership of his vehicle

(they wanted to show more proof of assets)

A few days later we were approved witha multiple entry! I dont know what got ours accepted, but I am very thankful it had been since it helped us a lot. If anyone needs more help/details I am more than happy to assist!
