applying for spousal visa while on study permit -please comment everyone

hi ,
(My friend would like to ask this query)
If an international student who is staying here for around couple of years (will graduate in April 2013) ,go back to home country and get married to his fiance ,can he apply for her TRV after they get married ? or
2- its better to apply for her study permit (if she get admission in school) ?
3-what documents would be needed for that (please provide details)
4- Do we have to show any supporting docs?
5-how will i prove our ties since immigration officer may think they have intention to settle down there.
6-how much bank balance (in Canadian and home country bank)?
Please elaborate in detail ,and if u have anything to add or any suggestion please feel free to add.

In both cases when applying for TRV or study permit from abroad she has to show strong ties to her home country. The best way is, in my opinion, for her to apply for Study Permit from back home but don't get married yet, because if she has a close family member in Canada it's not a good sign for officer to issue a visa, because he will think she is not planning to go back after her studies complete. While it's ok to have a dual intent (to study and then apply for PR in Canadian Experience Class), it is not recommended to mention the possibility of staying in Canada in the application. I hope you guys can find a right solution for your situation and be in Canada together. After she comes to Canada you can get married here. It is much easier to extend your stay here than apply from abroad.

The best would have been to apply to join her husband, in that case, she can apply for open work permit or visit visa and proving ties to home country wont be necessary as such because the greatest tie one has with his or her home country is spouse or kid, but be rest assured Canada respects family application alot. But my fear is that the guy is already in Canada before marriage,in that case that marriage may look ''arranged'' to the embassy, meaning, the marriage is just ''cooked'' to move that person into Canada. Thereofore, you guys may consider the wife applying for student visa.

As regards bank account:

1. If you want to join your spouse abroad with open work permit, you personally need to show 4,000 Canadian dollars plus To-Fro flight fare. Your spouse in Canada may be a sponsor, in that case, the spouse may show his bank account that shows enough money for his study and extra 4,000 Canadian dollars with To-Fro flight fare for the person being sponsored.

2. If you want to present account for study permit, if sponsored, lots of money has to be there because embassy believes that the sponsor also has his or her own family, therefore, the account has to be in excess. But if the applicant chose to use her personal account, she has to show the sch fees for the first year only, depending on the sch plus one year upkeep money (10,000 Canadian dolllars). Also, To-Fro flight ticket fare. Meanwhile, they will also like to see signs of financial ability to be able to cope with subsequent sch fees, this can be proved by a running account or business papers.
Mathematically....ACCOUNT = One yr sch fees + One yr up keep ($10,000) + To-Fro flight fare
