Applying for Sponsorship while on Visitor Visa

My husband is here on a Visitor record for the summer. The Record expires August 15th. I want to apply to sponsor him to stay here permanently. How do I go about applying for him to stay while he is here in canada? Is it different paperwork then the papers you would be filling out if he was outside the country?

Also will we need to reapply for his visitor visa while waiting on approval for permanent residence or will the receipt from the paperwork be enough validation for him to stay?

Hi There,

You can sponsor him through the Family Class Sponsorship from WIthin Canada. Just go to CIC website and start by clicking on "Apply to Immigrate", and go from there. If you are legally married you´ll sponsor him as your spouse.

The only thing is that he´ll need many documents and translations , if applicable, and it takes quite a while to prepare the whole package, so based on the due date you provide here, you should start quickly checking which documents he already has and which ones he needs, and calculate times for all that. Once you apply for PR, he has implied status, that means he can stay in Canada during the process as long as your package is complete and you both are approved. Remember to also apply for an Open Work Permit together with the PR application.

If gathering all docs is going to take you longer, then he should either go out of Canada and come back, which could actually be useful if he needs to get docs form his home country, or else, he can extend his stay as a visitor.

Which was is the fastest and easiest? He currently doesnt have a "home" to go back to in the united states but if necessary we are considering renting him a room across the boarder closest to where I live if we have too.. It would cause some financial struggles to have two households but if its the quickest way to get him here we will do it. Also being we are married will my income be a determining factor on whether I can sponsor him? I do work but with a little one Im only able to work part time until he is here.

If he is from the U.S I think Outland is faster.
He can apply Outland even if he is here with you in Canada.
The only thing is that I read on CIC website is that if you want to apply for a Work Permit together with your PR application, you can only do it if you apply Inland.

Im worried they wont extend his visitor visa due to having no money in the bank. Being he is currently unemployed and not allowed to work he doesnt have any money.. I have a home and I work part time. but I dont have much savings in the bank either to show any sort assets

For spousal sponsorship....income is not the factor.

If he can't show sufficient finances, the visitor extension would most likely be refused. How are you guys supporting yourselves?


For spousal sponsorship....income is not the factor.
OP is referring to a visitor extension, which depends largely on financials.
