Applying for restoration of status

I am in Canada for 7 months on temporary resident visa.MY wife is a Canadian citizen and My inland spousal application was just submitted 2 days back. Should I apply for restoration of legal status in order to apply for open work permit ? ( I have temporary resident visa valid till 2017)

Since you have been out of status 1 month ago, you can apply for restoration of status since there is 60 days window left for you to apply. There is a 90 day window since your legal status expired, to apply leaving only approx 60 days left.

You can try to submit an OWP at same time as ROS. I would suspect that your OWP will be rejected on account that you no longer have legal status. You need to have legal status in order to apply for OWP.

Thank you , if I am rejected my OWP since I don't have a legal status is fine as long as my legal status gets restored. Thank you SCreech339, I really appreciate your help.
