Applying for Residency OUTLAND question!

Hi everyone!

My fiance and I are getting married at the end of the summer in 2014 and I plan to apply for canadian residency some time after the wedding but I intend on applying outland. Once I apply from home here in the states, how long must I wait before I can return to Canada to be with my husband again?? Or do I have to wait to return for a certain amount of time while the residency application is being processed??? Does anyone have any idea about this?? Help!

You are visa exempt so you can come back and fourth for as many times as you wish . That is if you have an american passport . I would suggest if you are flying that you have a return ticket, and always make sure that you have proof of ties to the U.S. so they don't think you will overstay your visit. Saying that as an American you can stay in Canada while applying for your application , but will not be able to work. and still apply outland.

So if I apply outland I can leave the USA shortly after and return to Canada? There are so many little details I keep thinking about in my mind that pop up! I don't really want to stay apart from my husband for months at a time if I don't have to. Thank you for replying

Don't forget, you can only "visit" your husband. You can't "move to Canada" just because you have a PR application in process. You are subject to normal visitor restrictions.

Zardoz , as long as she don't turn up at the boarder with a pile of stuff and say she is visiting her husband , can she not then stay for 6 months and renew her stamp by crossing back over to the states or ask for a 1 year stamp ...

She can. However, she can also be refused entry, just like any other visitor. A lot depends on just who is on duty at the time. Most people don't have a problem, a few do.

You can "visit" Canada for 6 months without having to leave. Then you can simply go back to the USA and return again for another 6 months. Or, if you wish while you are in Canada you can apply online for a visitor extension visa, which most likely will be given, and not have to leave Canada at all. This is what we did, even renewing the visitor visa a 2nd time, with no problems. As a result we were able to stay living together in Canada during the whole time of the PR processing.

Yeah I was just actually looking up how to apply for an extension because obviously i'd like to stay for at least a little bit before i return home! I was thinking of working in washington state while visiting in canada for an extended amount of time just for the sake of income!

Are you suggesting you'd be working in WA while 'visiting' Canada for a prolonged period of time? So crossing back and forth regularly (daily?) for work? I'd be really careful about that because the border guards will realize you are living in Canada and just commuting for work. They probably won't be okay with an American going to the US and coming back to Canada on the same day on a regular basis.

For example, my husband moved to Buffalo from Tampa so he could be close to me during this process. He had only been visiting me for a month in Canada and went down for an interview. I went with him and we returned to Canada the same day. The border guard sent him inside and he had to explain he was not planning on commuting back-and-forth (which was a ridiculous idea as even though he lives much closer to me now, my home is still 3 hours from the border). Still, he was interviewed for a bit and the guard stamped his passport saying he had to leave in a month. He now comes to visit every other weekend and they don't have a problem with it because it's obvious he's not commuting. It's just something to keep in mind when you're financially planning a prolonged visit.

Yikes, I was thinking of doing that but I thought it was permitted. Why does this process to be with my soon to be husband seem impossible?! I just hope something works out, we weren't planning on having a lawyer help us with this process but it sounds like we might need one sometimes because I have so many questions. I don't want to do something stupid that I shouldnt because I'm not sure! Just when I think I know the rules I realize I dont, ah!! lol Thank you everyone for any responses, I appreciate it.
