Will i need permission from my childs father if we recieve an ITA? His name is not on her birth certificate.

Unless you have sole legal custody, and can prove it, yes.

he has just not been in her life since she has been born... never signed the birth cert of anything. So i guess i sole custody...whether its legal or not i dunno? yikes!
