Applying for Canadian PR while on H1B Visa in USA

Hi,
I'm planning to apply for canadian PR in FSW for software engineers NOC. I meet the required criteria and have > 67 points. I'm currently working full time in USA on H1B and have no immediate intention of moving to canada as such. My primary reason for applying for PR is for my wife who is currently on H4 (dependent visa) in USA and can't work in her field (Marketing) due to lack of work authorization. Since I can add her as dependent on my application and she will get the PR at the same time as my PR, the plan is, she can move to Canada and start working while I'm working in USA on H1. She will continue doing this till my green card is processed in USA at which time she will come back to USA.

Given this scenario, how likely do you think we are going to get a PR? Will the immigration officer who verifies my application reject it because he/she some how thinks that I wont be moving to canada since I have a H1 job here in USA and only applying for my spouse to get PR?

Will my PR be rescinded after being issued, because I'm not living in Canada officially (no utility bill, no rented apartment, no SIN etc on my name) and only my wife has all this since she will be living and working there?

Will there be any issue at border crossing, when we both visit US and canada every month to see each other?

Am I just being paranoid or should I be worried? We can also apply with my wife as primary applicant but not sure how likely she is gonna get 67 points (IELTS exam still pending) and so don't want to risk it with little time left this year.

Any advice or suggestions?

All things aside, 2173 is most likely already capped. So, your only chance might be through your wife as a primary applicant.

Your wife can live in Canada while you continue to stay in the US. One has to live in Canada for at least 2 years out of the 5 to be able to renew PR after 5 years. If you don't live in Canada, you will lose yours but if your wife fulfills the residency criteria, she will be able to renew hers.

Also, CIC won't know stuff that you don't tell them. However, I do think it is a misuse of the PR the way you intend to use it.

It might already be too late to apply under 2173. If you want to apply under this NOC then you should apply very soon (within the next couple of weeks).

Where are the latest application CAPS information for each NOC? I looked at the link on the canadavisa.com home page titled "can you still apply" and it says that the current applications received is 392 out of 1000. So that's less than 40%. From where did you guys the info that it's already full?

Is there any other site that has latest official stats about the NOC cap status?

I had the same question few months back..the point which they claim is, the number that is shown in CIC website is only till June mid (no. of applications that are received till june mid). so in that case there are many more applications for June, July, August and september month which are in queue...so your application will be last in the queue if u apply now...so there is only 1 possibility that if all applications ( june, july, august and sept) in total doesn't count more than 300 then u have a chance but thats not reality

It's not speculation at all.

Right now the numbers you see on the web site are as of June 17th (give or take a few days). They reflect the applications CIC has opened and approved for further processing. This is how it's always been (i.e. the process has been the same for years now). The numbers do not reflect the number of applications currently received per NOC (CIC has no idea what this number is because they don't do a count until the application is actually opened). Every year we have people who are convinced the numbers on the CIC web site reflect applications received and every year these people are disappointed to find out this isn't in fact the case when their applications are returned due to the cap being reached.

If you look at the site where CIC posts the numbers carefully you'll note it says: "Number of complete applications counted towards the 1,000 sub-cap." It clearly says "complete" and not just "received". Complete means opened, reviewed, and approved for further processing.

We know they are working on June 17th right now because as soon as an application is deemed to be complete CIC charges the fee and members of this forum have been reporting the progress of their fees being charged day by day here:
