Apply Study Permit within Canada

Hi everyone,

I am asking for a friend regarding whether can he apply for a study permit within Canada or not. He is a Chinese citizen and he entered Canada as a visitor on Sep this year. After doing some assessment tests, he has been accepted into a public high school grade 9 program (LOA indicates that from 201909 to 202006). He is currently studying at that school. His parents are not a Canadian citizens or PR. I have some questions:

1) Does he allow to study for the grade 9 program right now with a TRV visa?
2) He is going to apply for a study permit within Canada, using the current LOA, will it be possible?

1. He should not be attending a Canadian public school without a study permit or paying international tuition. He should stop attending immediately since he is not following the immigration laws of Canada. Does he have a guardian? There are pretty strict requirements for what needs to be done as an international student.

2. His chances of success will be much better if he applies from China. The fact that he seems to have arrived and attended school is problematic. He also seems to have arrived in September which shows that he likely intended to attend school. He should admit the error since if CIC finds out he will get banned. You may want to consult a lawyer about this.

Where are his parents? What made him think he could arrive in Canada on a visitor visa and attend public school? What kind of documentation did he provide to the school about his status, guardian, etc?

Thanks for your answer. But what if he stops attending schools immediately because it against the laws and he applies for the Spring term LOA for other schools. Will be it possible using that LOA can be used to apply for a study permit within Canada?

1) No - he is studying illegally and in violation of his TRV. He needs to stop immediately.
2) Yes - he can do that. Since he is a minor, he will need to have a guardian appointed in Canada before he can apply. He will also need to pay international student fees to attend school ($10,000 to $15,000 per year) and also show that he has an additional $10,000 to cover living expenses. His parents can show they have these funds (they should show at least $25,000 in savings although more would be better). Note that the fact he has studied illegally may impact his chances of getting the study permit approved.

Agree with @scylla. There is no option he must stop studying immediately. I am not sure why he thought he could enrol in the first place. He clearly arrived intending to try and attend school if he arrived in September. If not, he would have been getting ready for the school year or already attending school in China. Getting a study permit will take some time. The earliest he will hear about the study visit will likely be for next term. Why did he not apply for the study visit beforehand if that was his intention in the first place? The school would have asked about his parents or guardians or you would have completed an information sheet. Their address in China would have triggered questions about whether the child was an international student.
