Applied in Old FSW system, file terminate after medicals and RPRF sent ! help

Dear Seniors please help

I applied in old FSW program in Aug 2004 . .

I kept sending updated information to the london office as and when required by them

In May 2012 I received request for medicals and RPRF which I sent in July 2012 ---

After that there was dead silence and now my file no is deleted from their cic website and when i email them they reply that due to an act of law its terminated

My questions are:

1. is there still time for me to participate in the Cohen class action lawsuit ?

2. If I dont participate does that mean i will lose out on any beneficial verdict ?

3. Can i simultaneously still apply under FSW or business immigration while the case goes on ?

My understanding is that the bill to terminate applications applied only to those which had not yet received a selection decision (SELDEC = 1 on CAIPS/GCMS). If you had a medical request your application should already have been beyond this stage, and therefore should not have been terminated, IMO you should appeal your visa office about this decision and my understanding is that it is unlawful if your application reached medicals stage.

And yes, you can make a fresh FSWP application even whilst this application is still going on, if you are eligible.

But in my case, selection decision was made on 9 May -- and the cut off date was March 29 -- that is the act of law they are talking about . . .
