No no no Wayne, no need to be sorry and India is in northern hemisphere, in fact it is far away from the equator and if you want you can ski in India all year round but we have a separate rain season which is from June to sept, the summer is from march to June.
Cheers
Ok - clearly yesterday I was not thinking straight :) Also my geography clearly sucks!

Let's look at this logically.

<J2010 were eventually put into the "backlog" only after 6+ months of the new rules, and that was mainly because there were 144,000 of them left to process - CIC having not had the foresight to control the number of applications between Feb 2008 and June 2010.

CIC have had less than 14,000 total applications for FSW1 >J2010 - that's less than 10% of the total that were still outstanding for <J2010 when they were put in the backlog.

So in short, CIC have a lot less >J2010 applications to worry about - and from that and a PR point of view it would be political suicide to create a third backlog, having created a second backlog with <J2010 when they promised they wouldn't.

Also bare in mind it will be at least 2 months before the first >J2011 applications filter through to the visa offices - maybe more, by which time quite a lot of >J2010 will already have their visas.

So my guess is that they will continue to process >J2010 as a priority until the >J2011 applications come in, and then they will probably treat >J2010 and >J2011 as the same priority.

I am only guessing of course - but attempting to inject some logic into it! :)

Wayne.
Well this way the backlog only builds. There was one time when Australia disbanded most of its PR applications and went in for a complete new process. Hope that does not happen in our case.

But the number of <J2010 applications is easily handable within the visa processing year - unlike the <J2010 applications of which they have 144,000 and don't have the resource to process all of these.

If they cancel the entire backlog (which I believe if you include pre-Feb-2008 is around 300,000) at around $1200 average processing fee - this means they would have to give refunds in the region of $360 million.

Please also remember they cannot afford to simply blast through 300,000 applications for pre-June-2010 even if they had the resource to do so, since this would flood the Canadian job market with many applicants whose occupations are no longer in demand.

So IMO the only way forward is to ensure that a third backlog is not created (this should now be easily achievable with the capping system) by keeping on top of >J2010 and >J2011 - and processing pre-June-2010 gently into the system over a few years. This is why pre-June-2010 have been told it may take 2 years or more to process their applications.

So whereas I think CIC have been stupid in allowing 400,000+ applications in for Feb2008 to June2010 without controlling the intake numbers - having made that mistake, I can't see any way round the current situation other than to keep doing what they're doing with regards longer term strategy.

Shorter term - they need to seriously improve communication and look at the disparity between visa offices.

Wayne.

hi wayne,

i need your help with my case....

NDVO has asked me for my passport/rprf is encashed and medicals are done. rprf was encashed on 1st june 2011. my noc is 4151 psychologist. throughout, NDVO hasnt asked for PCC to be submit from our side. so we didnt.

a) u think we should send the pcc of our own without them asking for it?

b) my husband had studied in canada for one year in year 2004. does he require pcc from canada also?

c) how much time u think we would get our passports back?

d) u think chances are there to get visa if medical/rprf/passports asked or still there can be anything left?

here is my quick profile..

app filed:- 25 oct 2010
acknowledgement by CIO sydney:- 8 nov 2010
file transfer:- 24 feb 2011
medical request/rprf/passports:- 20 april 2011
passports sent:- 20 may 2011
medicals done:- 25 may 2011
rprf encashed:- 1 june 2011
present date:- 26-06-2011 (waiting for result from embassy)

i would be thankful if you can reply on these...

also, i request other seniors also, if they can contribute to my query....

thanks..

good analysis Wayne, but I was informed by an immigration consultant on linkedin that there is a chance CIC might not issue new list on 1st July 2011 (I mean they may stop accepting new applications to clear the backlog), if CIC issued new list of occupations on 1st July 2011, that will be the first priority, application submitted in between 26 June 2010 to 20 June 2011 will be second priority and all prejune 2010 applicants will be third priority.

Hi to answer your questions:
a) u think we should send the pcc of our own without them asking for it?
Did you send a PCC with your original application to CIO? If not then you will certainly need one before the visa if granted, and I am very surprised they have not yet asked for it. Do you know how long a PCC will take to get? Certainly worth looking into acquiring one but I'd probably wait until they ask for it before you send it.

b) my husband had studied in canada for one year in year 2004. does he require pcc from canada also?
Check your visa-office specific checklist. I believe you need a PCC for anywhere you have lived for longer than 6 months, but not sure how far back they are interested in. If they do not specify a date, then assume it is since aged 18.

c) how much time u think we would get our passports back?
New Delhi works differently to most other visa offices in that it asks for passports along with medicals. Most other visa offices only ask for passports when they are ready to issue the visa. Looking at other people's timelines here for New Delhi, it is likely to be 2 to 3 months.

d) u think chances are there to get visa if medical/rprf/passports asked or still there can be anything left?
Not sure I understand this question - do you mean are there chances that anything can go wrong? Well, once you receive your medical requests it means that eligibility is completely agreed and also the background checks on your documents are complete. So at this stage - realistically the only thing which can fail your visa is if you are medically or criminally inadmissable to Canada - so I'd say 99.9% of applicants will get a visa once they get medical requests.

However, delays can occur at visa office, so some patience is also needed.

Hope I have been of help, and best of luck,
Wayne.

a) no, as cio n ndvo checklist said that pcc is to be sent at later stage when requested, we didnt send it earlier. also we have got our pcc in process now and will get it by tommorrow and i am planning to send it tommorrow....

b) i read it somewhere that if a person has resided in canada for a year or something then pcc particularly from canada is not required as they will check of their own from canada. i will check about it from other websites also and would upgrade....

c) wayne, most of people are getting their passports stamped in around month..month and half or so...i was wondering what would happen in our case....lets see now...

d)are you sure they are done with background check? people have different views regarding it.....

also, i would suggest to all the applicants...send all the documents and information as much as you can initially whether the visa office asks or not..coz if sometimes vo doesnt ask for pcc..like in my case...then the process can delay...

thanks wayne for your answers...n m on wait list again... :)

I'm beginning to think that they have kept aside my application as an ideal application that the prospective applicants should aspire for when they apply......Any one else feel that?? ;D :-\

And one more question. Do you think that the new Noc will affect it? What if the occupation is not in the new list? Then they might process it as backlog, since it'not anymore in demand?

I dont quite agree with point no. C about visas ...

There are hundreds of applicants like us who were the first ones to send our passports (for the current session) in March and we're still awaiting PPs. This is 4th month running. RPRF encashed 2 months back.
