Hi guys,
I had applied under FSW in Sept 08 and my job exp do not fall into 38 list. They sent me a file number, which i used to enter online and see my application status. Until last week, the status was "In Process" and they started processing my application in March 10, of 09. Now this weekend, i see they turned the status back to "Application Received" on Sept 28' of 08.
Can anybody advise me what this means? After i knew that i do not belong to 38 occ list, the only thing i am desperately waiting for is my application fee. I would appreciate your thoughts on this...

definitely, if your work experience does not fall under the 38 list of jobs your application will be refused at the first stage and your fees will be refunded

would you please tell me what is work experience title and duties ?

Thanks. No doubt my application will be refused, thats why the only thing i am waiting for right now is my money (fee). My concern (with this change of online file status) is whether i will have to wait more time to get my money back.
btw, my job exp were RA/TA (code 4122), and Program Officer (code 4161).

Dear friends

All applicants who applied after 27 February 2008, will see the same status. I have also seen this. Actually now the time is started to review the applications. CIC say the decision for processing an application will be determined within 120 days. Applicants who do not fall under 38 NOC list will get a refuse letter and the refund.

Now we want to know, when will the refund reach to the applicants ? Some say it will take about 6 weeks or a little more.

Pls. share if any further information is available to anybody.

Thanks.

Just wanted to inform all of you that i recieved a letter from CIC today, saying that my application will not be processed and fee will be returned within few weeks. The reason is that my experience did not fall among 38 in the new list. See my application details in the beginign of this thread.
There were several threads in this forum about the possible exemption for those who applied between Feb and Nov, 2008. I also read this in their document released in May 09. Despite all of those, they are not considering those not in 38 list, and i am just relaying this fact to everybody interested.
Good luck guys...

You dont need to contact any one. If you have your #B, go here and check yourself by entering required data...

Dear smokey
This is a very sad news. CIC are not following their rule of "EXCEPTIONS' for those who applied 27 Feb- 28 Nov 2008. Very disappointing !

I think same thing will happen to me. I am waiting for the letter & the refund.

Now, do you plan to reapply for canada immigration in any other way ? Pls. keep communicating.

Best of luck.

SYED,
I was also surprised a bit, as their official document says they will assess the applications (recieved bet Feb and Nov 08) in a way that favors the applicants. But its okay....
I dont plan to re apply or do anything unless they make a significant change in their rule.

Dear Smokey

What I understand from your thread is that there are opaque chances of accepatnce of applications received between feb to nov 2008

Please comment to improve discussion

Thanks

Manvi,
My impression is that the discussion of exemption or reconsideration for those who applied between feb and nov'08 and did not fall under new list of 38 occupations is not true. I wish all others good luck, but my case kind of suggest that everybody with similar case will get the rejection letter soon. I probably happened to be the first one (at least among the users of this forum) to receive this bad news.

smokey, may i suggest you something ?

As my case is almost like you and i am also waiting for a rejection letter, I decided i would write a letter to CIC after receiving their refusal letter explaining their rule of exceptions (application between 27 Feb-28 Nov 2008) as an appeal.

Can you not write a letter to CIC as an appeal ? and lets see whats happen. At least nothing to lose if a letter is written to take an opportunity.

Good luck.
