Application Refused

Hi,

I've applied in March 2012 and today I got refusal letter saying
"I am not satisfied that you meet the skilled work experience because you have not acquired 12 months of full-time Canadian work experience in a NOC type 0 or Level A or B within the 24 months before the date the application is made and after you have acquired a Canadian educational credential; work experience acquired before graduation does not qualify. "

I joined my Previous job on February 08, 2011 (PGWP issued: March 8, 2011).
Application submitted: March 01, 2012.

Which indicate that from my PGWP, I've less than a year (12 month).

I thought on this guys, whether I can re-apply or not?

Please give me some advice.

I'm still working (which is more than a year now).

Thanks

Hi there,

I am a little bit confused because after finishing school we are allowed to work with our off-campus work permit till we receive the PGWP but that doesn't mean the work experience acquired during that time is considered before graduation. Your graduation date is well before the PGWP issue date obviously. So that doesn't make sense to me. The only thing I can think of is your working hours. Did you work 1950 hrs before you applied? Maybe your hours weren't enough even though you had worked there for 1 year?

Also if you have enough hours now, I would apply again.

Sorry to read about your refusal. Work experience obtained under the off-campus work permit is not counted. To be on the save side, you should start counting work experience after your graduation. If it's been a year since your graduation, you may re-apply.

The thing is after graduation it takes them 2 months to issue the PGWP and during that time if someone finds a job right away, you are allowed to work with the off campus work permit. But obviously it is after graduation. So you are saying that time would still not be counted?

@Ozge...Unfortunately, the CEC guide isn't very clear on it and I don't know either. As you say, it could take 2 months to receive the pgwp, but we also know that work experience obtained on the off-campus work permit does not count. That leaves us with the conclusion that you must graduate and receive the pgwp before you begin counting experience to be on the safe side.

@new_56... if you graduated by March 8, 2011(when pgwp was issued), then you may re-apply.

@SenoritaBella: If that is the case, their instructions are useless. Because the only information they emphasize is the work experience has to be gained after receiving canadian credentials. They don't say only the experience gained after receiving PGWP will be counted. Plus we send in our diplomas and transcripts that has all the date information. I graduated in May 2011 , started my job June 2011 and my PGWP was issued July 21, 2011. I counted my hours starting from June 2011 and submitted my application. Now I am all worried :S

Check with the CIC call centre. No need to be worried because we don't really know if that is the case. Sit tight and wait to hear from them.

1. If you intend to re-apply, you must submit a new application package.

2. Don't think it's required - old application forms used to ask if you had previously applied for PR, but I don't see that anywhere on the new forms... (let me know if you do...?) They will know anyway...

Hi jes_ON,

Thanks for your informative reply.

I've more question,

1. Are they going to return my application package?
2. Should I contact CIC (OttPilot-immigration@cic.gc.ca) an ask them if I should state my file no.?

Any other suggestions you may?

Thanks

1. No...it's now the property of the gov't of Canada. However, if you request caips/GCMS notes for your PR application, the entire application(minus supporting documents) will be sent to you. Note that as your old file is now closed, it could take up to 2-3 months to receive it.

2. You don't need to quote your file number. The new application will have a new number.

@Ozge... I found this in the CEC guide: http://www.cic.gc.ca/english/information/applications/guides/5609ETOC.asp

Note: The experience must be acquired after you have completed the required study and obtained a Canadian credential (work performed under the Off-Campus Work Permit Program or co-op work terms do not count).

Note that the credential is obtained when you graduate.
