Application Question (Conjugal Visa)

Hi All,

My partner is married in the Philippines so we are proceeding with the conjugal visa application. She is not annulled nor legally separated.

On the general Application Form (IMM0008) there is a question in regards to her current marital status: Annulled / Common-law / Divorced / Legally Separated / Married / Single / Widowed

Which option should she pick?

Chances of approval are very dim as she is not legally separated

Philippines is a country that doesn't have divorce correct? as for your question you would hafta tell the truth she is married...(if answer to question is yes) then put in writing that her country doesn't recognize divorce, she will have to prove that her and her husband are no longer together and that you have had a conjugal relationship for atleast 12 months. It is the hardest way to apply and the hardest to get approved but not impossible.

Thanks for the answers, folks!

Yes, Philippines is the only country left that does not have divorce.

I strongly believe we can prove we have been in a conjugal relationship for 12+ months (phone bills, photos, shared insurance + credit cards, sworn affadavits from friends and family, etc.)

Hi CmDrDan, we applied under the same category as you. We also don't have legal separation, as his ex disagrees to sign anything unless it's for large sums of money. I will just check my imm008 and get back to you as to what we put.

Ok, this is what I put. I'm not sure if it was right or not, but it was the best I was advised by some of the senior members here.
His marital status should be "Conjugal" as well as mine because from what I understood, for the purpose of this application he is in a conjugal relationship with me. As there was no option for Conjugal in the drop down field I had to put "Common Law" and attach a note to say that it meant to say Conjugal but as there was no field for that so I had to write common law.. as we both know it's possible to be common law while still legally married to someone else and that would raise the same question, so I think the main focus of the questions there pertain to your relationship with each other.
The forms were tricky and there were a few instances when I really wasn't sure what to put.

Also for the next question where it says were they previously married, and it gives a date field, I just extended it until the date their marriage broke down. Then attached a note to say they were still legally married and the end date on the form was around the time their marriage broke down.
I don't want to screw up anyone else's application so please get other advice. I'm still waiting for sponsorship approval.
