I am in the process of applying to sponsor my wife to live with me in Canada. My wife and two children currently live in the UK. I am aware of the application process for her but have questions about the children.

Both children are automatically eligible for Canadian citizenship as I was born in Canada. Our first son is 2 years old and has his Canadian citizenship certificate and Canadian passport. Our second son is only 3 months old and only has a UK passport. We will be applying for our second son's Canadian citizenship certificate and Canadian passport shortly.

My question is do I and/or my wife need to include either or both children on the application forms as dependent children or are they automatically allowed to reside in Canada as they have (or will soon have) their own Canadian citizenship certificates and Canadian passports? I appreciate that the answer may differ for both children.

As a corollary do I need to submit the 8 required identity photos for the children referenced in the Immigrant's guide? Are these photos required only for the principal applicant or do I as the sponsor also have to submit them for myself?

Regards,

No, your children are not considered dependents to sponsor so don't need to be included as such and don't need photos or medicals. They are simply listed under the extra family info form.

Thanks for the quick reply. So just to clarify, my wife doesn't need to include them as dependent children on her application forms either?

So these are the specific questions that are tripping me up - I want to be absolutely sure that I'm answering them correctly.

i) On the Generic Application Form for Canada (IMM008) - question 3:

Q: "How many family members, including you, are in this application"

Should I list 1 (wife only) or 2 (wife and child that doesn't yet have a Canadian passport) or 3 (wife and both kids; one of which has a Canadian passport)?

ii) On the Generic Application Form for Canada (IMM008) - page 3 of 9:

Q: DEPENDENTS - You must provide the following details about each of your family members, whether they will be accompanying you to Canada or not. You must include your spouse... and all of your dependent children, and those of your spouse...

Just to be clear, I list both children

Thanks in advance,

i) List only your wife. You can get your child's passport faster/cheaper than she will get her PR.

ii) Yes, list all your and your wife's dependant children (in case one of you had children outside the relationship beyond these two).

No, I just stated they are NOT DEPENDENTS for immigration purposes. They are already Canadian so are not being sponsored. The form on page 3 even states in bold you only include those "who are not already permanent residents or citizens of Canada"

They only go on the "Additional Family Info" form: http://www.cic.gc.ca/english/pdf/kits/forms/IMM5406E.pdf

While everywhere says you don't have to include info on your already Canadian children I had an additional documents request to see my daughters birth certificate so it won't hurt to put a copy in to avoid delays. They just wanted to see that both my husband (sponsor) and my name were on there.
