Application Approved. Need Help!!

Hi, we applied outland from the U.S. in March of 2016, they didn't receive it till April and we already got approved! I wasn't expecting to get it in less than a month, but the problem is that we cant move until our lease is up, which is in March of next year.

From what the website says 15 months, which was kind of what I figured, but not this short. Is there a way I can call CIC out of Canada to see what options we have. Or if anyone has some ideas on what to do. I know there is no extension.

They give you a final date to land. Should be in your COPR when you receive it. You can land sooner obviously, but if you don't enter by the date they give you you will lose your PR status. You should've waited and applied later on.... You will have to break your lease and find someone to take over or risk losing your residence there.

No that's not correct, I spoke to CIC and they said you can enter Canada and leave again right away as it is a common thing. Why would have I waited when the time frame is over a year processing??

Yes this is correct. I do not know your complete case, are you tagged under Cond 51 ( married less than 2 years ). If yes, sponsor and PA have to stay together at same place as much as you could. If not, i wouldnt worry much as long as residency obligations are met.

They are living together in the US. There is no Condition 51 violation. They are free to do a short landing, both return to the US and continue to live there until they are ready to return to Canada.

You did the right thing by applying early as you never know if your application might get stuck for any reason.

So, I think it already got cleared up, but just enter Canada using CoPR once... return to US and come back later. You'll be asked to give an address where PR card should be mailed and I believe that address hast o be Canadian. So make sure you have address for that. US nationals are allowed to enter Canada without PR card anyways, but might be better if the applicant has it in their possession when they enter the second time.

I totally forgot you wrote you and your spouse are living together, as others said you can land and go back... But wouldn't cic make problems with that later on? From what I know, if a Canadian is permanently living outside of Canada they have to proof their intentions to move back once the spouse is granted pr..? Maybe someone can shed some light on that as I always thought if you leave right away it might cause problems if cic found out?

No, it should be fine. Lots of people get the PR visa at an inappropriate time, so the best thing to do is to just land, then go back home to finish up whatever you have to do. As long as you keep up the residency requirement, it should be OK.
Particularly here, where the couple lives together, they won't have any problem.

Only if you don't show you intend to settle in Canada during the application process. They don't care what you do after, as long as you fulfill the PR residency requirements, which aren't that demanding.

I see, that makes sense. I thought Unless you worked for a Canadian company abroad, that they would give you problems. Not sure where I read that. Thanks for clarifying

We applied in March too and I think as soon as I send in my FBI clearance we'll get approval pretty fast too. My hunch. But we weren't expecting it to go this fast either. I don't know what state you live in, so you may have some options for breaking your lease depending on the laws there. Otherwise, just know you won't be the only one landing and then coming back to the US

So for the first time entering Canada to do your interview at the border, do you have to drive through if you are returning in the same day back to the U.S?
I read somewhere that you can't fly back out of Canada until you get your PR card. You need a Travel document?

You can do flagpole. Nothing stops you. Better way, do some shopping in Canada and return back to US. As far as your second question, again, You can fly back out of Canada until you get your PR card. Assuming so:
a) You need a mailing address, which has to be
1) Non Quebec Address: Assuming your application/primary location in Canada is not Quebec. It could be a friend or family or someone whom you trust, who could receive your PR card.
2) Quebec Address: If you have CSQ approved.It could be a friend or family or someone whom you trust, who could receive your PR card.

Quebec shares immi­gra­tion laws with the fed­eral gov­ern­ment of Canada. How­ever, the province signed an immi­gra­tion accord with Canada. Que­bec is respon­si­ble for select­ing the work­ers wish­ing to set­tle in Que­bec, to achieve cer­tain immi­gra­tion objec­tives. But the fed­eral gov­ern­ment of Canada is still respon­si­ble for admit­ting the immigrants. There is additional bunch of documents and a different process for Quebec region. So make sure your mailing address is correct.

b) If you are in sponsorship visa, more time you are together, whether within Canada or not, it would be better per Cond 51. Not sure if it applies to you.

They are living together in the US. There is no Condition 51 violation. They are free to do a short landing, both return to the US and continue to live there until they are ready to return to Canada.

Living together in US or not, doesn't form basis of cond 51. If they are married with in last 2 years, and do not have any kids, they could possibly get Cond 51.
