Hello,

Due to unforseen circumstances, my husband (Swedish) and I (Canadian citizen) are having trouble completing his application before his visitor status expires. We are having trouble getting certain forms and they are due to arrive by mail after his visitor VISA expires on Nov. 6th.

What can we do? Should we send in an incomplete application and send the other forms when we get them? Or should we apply to extend his visitor VISA and submit the application when we have all necessary parts?

If we apply to extend, what do we say, that we are waiting for documents for PR application? Will that hurt his chances of getting the extension?

We are very upset and confused, please help!

Send his PR application when it's complete. When you send the extension in, include your marriage certificate. As for what to tell them, I would defer to others who have done the process.

Ok, thank you. It says it takesd 49 days to process the extension, during that period his status is implied, correct? And I can then submit the PR application as soon as we have all the components (i.e. even if he hasn't been granted the extension yet?)

When they receive the application (it's in the mailroom at CIC) he is under implied status until they approve or refuse it. If you forget and are late applying to extend his stay, http://www.cic.gc.ca/english/resources/tools/temp/visa/validity/restoration.asp

Not a problem. I know, my wife and I are in the process now...

Yes, state that you will be submitting the PR app as soon as the documents arrive. Include the PR fee receipt as proof that you are serious about applying and proof of finances to support his extended stay. There should be no issues.
