anyone not in 38 list & got rejected

Hello all forum member

I applied in July 2008 & myy occupation is not in 38 list whenever i check my file status it shows in process. on march 04 it shows that my file has been transferred to Nova scotia . Is there anybody on forum who has applied but not in 38 list get rejection .

My case is similar to you. My application also transferred from singapore to Sydney NS on 10 March 2009 & my job is not under the 38 NOC list. I am waiting for a refuse letter and for the refund to take next step.

There is a possibility to process one's application (not under 38 NOC list)
if the person has job description similar to any job of 38 NOC & having experinece of leading people.

just wait & see.

Hi syedrahman1980, this is something that I do not understand. When we fill out the applcation form for FSW1, it asks for NOC code. Now whoever is filling up the form will most of the time will fill correct available NOC. Then how application gets rejected on this basis?

I am also planning to apply under FSW1 category and trying to understand the things to do and not to do.

both of them applied before the limited 38 nocs came out in november 2008, so they didn't know yet that there is only going to be 38 nocs that can apply retroactive to feb 2008. if you applied anytime from feb to nov 2008 and your nocs do not fall in the 38, you're application will be returned.

jtob is partially right.

Besides job title job description & type of job of an applicant shall also be checked by CIC to decide for further processing. If job description matches with any job tile of 38 NOC list there is a possibility to process further. As this is a new rule we have to wait another 4-6 months to know more about it. We are not clear about it since we have not any experience about it.
