Hello Everyone,

I would like to ask if there's anyone in this forum who is applying for an open work permit inside Canada.
I am a visitor here in Canada and I am planning to apply online, my husband is working here as a skilled worker , so I am eligible to apply for open work permit.

I hope someone here can help me.

I have a question though.
I do not have an offer of employment and I know I dont need an LMO if I applied for open WP, I'd like to ask what will I provide in the employment details? My visitor status will expire on Dec 2013.
Also, should I undergo medical?

As far as I know You will not need a medical if your temporary resident permit is still valid for 6 month. But yours is less than that now. So the CIC officer may or may not ask you to get e new one. Cross fingers that the one who will process your papers is having a good day. You needed to get a medical before you came here correct? How long ago was that medical done?

You do not need an offer of employment to apply for one that's why it's an open work permit.

Honestly speaking I put N/A on that parts of the application

Hello,

No, I did not undergo medical when I went here because I am just a visitor. When I was on the port of entry I was allowed to stay here in Canada until Dec 2013.

I just got married here and the marriage cert will be available on Sept per Service Ontario, so I will apply as soon as I got the marriage certificate.

I checked the processing times and it will take 30 days to process an online Open WP application, so I was thinking that before my stay here ends on Dec and if I will apply on Sept or Oct, there will be a result already.

I am also thinking of extending my stay here should my application for open WP got rejected, but I am hopeful that I will be approved.

What do you think? Thanks marsiangal.

The CIC website says that in some cases a medical exam will be needed, I'm pretty confident that this is one of them. As your status will change from visitor to worker. And as far as I know a medical is required for workers and students. Send your application in for the open work permit and see if they will ask you to get a medical. If your application is in process, that means you have implied status as a visitor while waiting for the result that means you don't have to apply to extend your stay.

thanks once again for your input.
so if i am to apply on Sept or Oct, and no decision has been made yet until the expiry of my stay, its okay for me to stay here without applying for a visitor's extension right?

I am just worried that if my application got rejected, I should leave Canada if I will not request for extension.
I thought of applying for the extension so if my open WP got rejected, my visitor status is extended.

I am really having second thoughts. ???

Yes that is what implied status means.
I'm sure there would not be a problem because your hubby is a skilled worker. As long as you answer the forms properly.

If worse comes to worse that your application was denied and your visitor permit has expired.

You can apply for a a restoration of status at the same time en extension of the visitor visa.
You must do this withing 90 days of the permit expiring.
And you can put the reason that you did not renew your permit because you have applied for SOWP and was on implied status and was expecting it to come without any problem. However it will be $200 dollars for restoration and $150 for the extension, You can also do that online.

I think it is up to you what you want to do.

I feel like if you send the application on September there should be an answer within a month or 2. So you will know if you have to extend it or not.

One thing that I am afraid of now.
I came here on a visitors status, got married and will apply for open permit.
I just hope, the visa officer will be nice to me and will not suspect that I am doing some ways to stay here.

I am sure that you are not the only one who have done this before.
Don't worry. You will be fine. :)

Non of my friends have been on the same situation exactly. But I know of a few people
Who are workers,only met in Canada, got married in Canada and the wife or husband was skilled. So got an open permit for the their other half. And didn't have any problem.

When you get a sowp, your spouse will now be mostly responsible
For you. And should make sure that his status is always valid, so that yours will be valid too.

And who knows maybe next time it is gonna be the PR now that is your problem. Lol.
