Hello, I’m looking for some advice or experience if anyone has it! We are February 2018 Outland applicants (timeline in signature). Unfortunately we haven’t heard anything from London VO since December.

I’m the sponsor living in Canada while my husband is PA living in the UK. I am due to give birth to our first child in May, and with our application being at an unfortunate stand still, we are wanting to be together for the birth of our child. Looking at options, I’m hoping to bring him here on dual intent/visitor visa.

My question is, are we able to change our application to inland and allow him to apply for an OWP so he can be over here with us? Or any other options you would recommend? I would hate to have to move back to the UK which would obviously decline our application after over a year of efforts. But it’s heart breaking to think we will be apart.

Any advice is GREATLY appreciated!! Thank you in advance! :)
 
As your husband is from the UK he is visa exempt and can come over to Canada under duel intent. He can stay for six months with an ETA - unfortunately during this time he cannot work and you’d need to show that he has the intent to go back, such as a return flight.

You may be lucky that he gets COPR whilst in Canada and you can complete a soft landing with your local case processing centre.

He should be able to enter Canada very easily as a visitor.

You cannot change an application from outland to inland. You would have to withdraw the outland application and submit a brand new inland application. Processing times would restart from scratch. OWP isn't an option with an outland application. He can look into the IEC program if he's the right age (although spots are always limited). Otherwise he needs a job offer and approved LMIA to apply for a work permit.

If you are Canadian, then you can leave Canada and still sponsor your spouse outland. Your application won't be declined. Although you may at some point be asked to provide proof that you plan to return to Canada once his PR visa is approved.

Thank you for your response! It was very helpful. I'm thinking him coming over before I give birth under dual intent would be ideal, I just am praying we hear from London VO before then.
Are you familiar with applying for a visitor's visa? Do you know how long it will take to get one?

If he holds a UK passport, he does not need a visitor’s visa. He only needs an ETA.
