any1 rejected for not disclosing a detention(no charges pressed,no conviction)?

Have you, or have you heard of anyone who had been detained, that didn't disclose the detention because of clean PCC(sent along application)... get rejected later (maybe accused of misrepresentation) because CIC finds out about the detention during background checks?

Even if someone else has heard of this, every case is different. Why would you risk it?

It would be more than an accusation, if you did not answer the question(s) regarding that, honestly.

You can always submit a corrected version of that form (or forms), as long as your application is not `processing' yet.

Yeah I concur...its not worth it. I've seen a few people run into problems who had forgot to disclose something from way back in their past, even recently someone posted on the forum who got into some issues over a police caution that they hadn't disclosed.

What do mean more than an accusation?


It appears I mistakenly thought that CIC was asking for arrest/detentions/jail time ordered by a competent judge/court. I thought it was not big deal if a police takes you into custody for a night and no charges are pressed, also because it is not mentioned in the PCC.

My case has received PER, but not AOR yet. Is it possible to send an updated form to CIC/VO and a letter explaining to them that I didn't fully understand the question?

I remember now from the London thread Gatawa04 hadn't disclosed his police caution and has now been called for an interview. Although his PC stated 'no live trace'. I think he thought along similar lines that as he had not been charged with an offence he shouldn't put it on the form.

I'm not sure whether you can resubmit the form given its already in process. Maybe Ponga can confirm that.

You will want to disclose the detention because;

(a) The fact that you were detained but not charged or convicted will not render you inadmissible, and

(b) Failing to disclose it might be seen as a misrepresentation which will most certainly render you inadmissible for a lengthy period of time.

A couple of other members had similar problems and stated that they were able to submit updated forms, as long as the applicant portion of the process (after AIP) had not commenced.

Because of what you originally wrote:

I just read about the UK PCC, it seems that if it says "no live trace" it means that there are old records.

In my case, my PCC says the same it said before the detention(same for all people who have never been taken into custody/arrested/detained), as if the incident hadn't happened at all.

AIP is Approval In Principle. It means that the sponsor is approved and the relationship has been assessed. The applicant's criminality and medical are assessed after that (typically).

Judging by the OP stating they have received PER but not AOR, I'm guessing that he is an economic PR applicant, not Family Class.
