Hi there,

Does anyone know apart from EOI lottery program, is there any other option to sponsor parents like on compassionate grounds etc.

I have already applied through the EOI program but since it is a lottery based program not sure if I will be invited. So looking for other options as well.

Any help will be appreciated.

Thanks

You can certainly try to apply based on H&C reasons if there are H&C reasons but if they get refused expect for them to have difficulty visiting Canada because there will be concerns that they won't leave. It will likely take 1.5-3 years to get a response. If your parents are both alive, able to care for themselves (even with a bit of help) or have other family members in their home country their chances of being approved based on H&C reasons decreases. There are lots of people who want their parents to join them in Canada but with an ageing population Canada is only able to accept a certain amount of parents and parent sponsorship is not guaranteed. Canada created the supervisa to allow parents to visit for extended periods of time. The H&C process is not meant as a way to bypass the PGP program if you don't get selected.

Thanks so much Canuck78 for your advice.

I believe there is at least some ground (although obviously still nothing is certain) for H&C option as my parents are in 70s and 80s, both have multiple health related issues and need someone to take care of them, do not have any of their kids in their home country (all us 3 siblings are in Canada and are Canadian citizens) & do not have anyone to take care of them.

However before applying on H&C grounds will like to exploit all other possible options. Also it might be a good idea to get a super visa for them first, before applying on H&C grounds so that if it gets delayed or rejected at least they could visit us.

I do have another question for you. Is there any data available for processing times for H&C grounds applications or any success stories in this regard?

Thanks

Most H&C threads are found in the asylum / refugee section of the forum. You may want to spend time reading through the discussions and stories there.

Processing times are generally around two years.

In order to apply under H&C, they must be physically in Canada under either a visitor visa or a super visa.

Thanks so much.

Yes I was just checking cic website and found the same. The application could be made from inside Canada only. So I believe the first step is to get a super visa for them.

Will definitely check your suggested sections of this forum as well.

If H&C is denied a supervisa may be cancelled so there is no guarantee that they would be able to visit if denied an H&C. H&C is for exceptional cases. Most parents in their 70s/80s have some health issues. Is your situation any different than others who immigrated knowing their parents would be left alone in Canada? How long have you been in Canada? Your parents haven't even secured a supervisa to visit for longer periods of time. H&C applications were taking 2.5-3 years to receive an approval or refusal. Recently there have been some cases that have been processed in around a year. H&C applications are very dependent on the case.

Here is an example of a judicial review so essentially an appeal after the H&C was denied to show you that even widows get denied.
