Hello!
I've been in Canada since the pandemic hit; I was visiting my boyfriend at the time, and still do not feel it is safe for me to return to the states. I've extended my visitor record, and I'm allowed to stay here until June 30th, 2021, and i wanted to see if i could apply for an open work permit while I'm here. I had question about the process, and if anyone can help that would be wonderful!

My visitor visa expires on June 30th; would a work permit extend this? I couldn't apply for the work permit until this was extended, and with how the waiting times are at the moment for these things to be processed, I wouldn't be able to work for very long if I were to be accepted. I was planning on extending my stay anyway. If the work permit does not extend this, would I be able to still work while extending my stay? How would this work exactly?

Thank you so much!

You are not eligible for an open work permit just because you are a visitor. How are you eligible for an open work permit? Is your boyfriend a citizen or PR? If so after a year you are common law and he can sponsor your through spousal sponsorship. You can apply for a work permit at the same time.

To get a work permit, you need an employer who will give you a job offer with approved LMIA (prove no Canadian could be hired). Then you apply for a closed work permit.

Based on the information you've provided, you do not qualify for an open work permit at this time.

If you want to stay beyond June 30th, you should apply for another extension to your visitor status so that you can remain longer as a tourist.

Once you and your Canadian boyfriend are either married or have lived together continuously for one full year, he can apply to sponsor you for PR. He can include an open work permit application with the PR application, It will take around five months for the open work permit to be processed and approved from the time the complete application is submitted. You'll need to wait until the work permit is approved before you'll be able to start working.

I thought i read something that open work permits were being allowed to more people due to issued related to Covid, but maybe i read it wrong!

Thank you for the info! and I guess I'll ask, I have been living with him for about a year now. does this mean we could apply? are there any income requirements?

There are some relaxations in rules but none that would allow you to apply for an open work permit. Open work permits are still issued in very limited circumstances.

If you have been living with your boyfriend for a minimum of one year continuously and have evidence to prove this, he can sponsor you for PR and include an open work permit with the application. There are no minimum income requirements however he cannot be on social assistance.

Hi all,

I will be applying for SOWP for my spouse in India. I am in Canada now in work permit. I have question whether IELTS test report is required/mandatory for SOWP online application?

Did anyone got refusal for not submitting IELTS test scores?

Thanks in advance
