Am I eligible to apply temporary working visa inside Canada

Dear all,

I'm a Thai nationality, traveling in Canada with a 6 months single tourist visa. My visa will be expired on 30 APR 2011.

Last week, I found a Thai restaurant in Alberta seeking a Thai Chef, I did call the owner of that restaurant, he is willing to hire me for a year and will provide a full support to apply me a Temporary Working Visa within Canada. The restaurant couldn't find any applicants, and urgently need one otherwise it'll be closed down.

I already have a Police check from Thailand and other Cooking certificates and Thai Chef's Certificates from Thailand as well.

Please kindly advise if my Temporary Tourist visa is eligible to apply a working visa inside Canada. (I really don't want to fly back to Thailand to apply outside Canada)

You have to send your initial work permit application to a consulate or visa office outside Canada. Your prospective employer needs to advertise to the job bank and a major daily or website for at least 14 days before s/he sends in the LMO application to HRSDC. Once a positive LMO comes back, that's when you send in your application together with your supporting documents or you can go directly to the US and apply for a WP there if you have B1/B2 US visa.

They OP will also require a medical before the TWP is issued.

If once the restaurant owner send the application to a consulate or visa office outside Canada, can I stay in Canada or I have to leave the country while waiting for the application result? I currently don't have B1/B2 US tourist visa. Please let me know if I don't have to fly back to Thailand as my home port.

It is you who are going to send the WP application to the US once a positive LMO is received. If you don't have a visa to the US you can always try sending the application by mail. Send to Seattle.
